Topic: Warning to Sac and Roseville folks

Was having drinks with my friend that is Sac PD. And if you havent heard they are going to be looking for modded cars over the next 4-5 days in the Sac/Roseville area. Mostly motorcycle cops but all will be enforcing this street race crack down so to speak. Things they are looking for is: Cars with huge Tachs, A pillar gauges, Cowl Hoods, Hood Pins, Loud Exhaust, Engine Revving, Erratic Lane changes.....Bunch of stuff. So just becareful and make sure your L's are not shady.

I don't have the cowl hood but I do have the Tach and Pillar Pods. I try not to drive my car when the sun goes down or even a Friday or Saturday evening. Plus it is too hot to drive it. I live in Rocklin and they are sticklers on everything. My Girlfriend has gotten two tickets for the windows being tinted and no front license plate in the Benz.

In the midst of all of these crackdowns...
They still need probably cause to search your car, remember that. With these supposed "crackdowns" carry a tape recorder with you, and have the officer establish PC on a tape recorder, and 99% of the time they will let you go.
They can't not just pull you over for a tinted window or front plate, and all of a sudden search under your hood.
Always question his probably cause to search your car, we have rights we should practice them.

If you get a ticket for tinted winows, front plate, etc you have to correct the problem and then get it signed off by an officer or at the police station.
If you get a ticket for illegally modified engine/smog violation then I think you actuall have to go to a ref for a "smog inspection". This is a lot more serious.
This whole "crackdown" thing seems to be a re-ocurring theme.

problem is, that when people actually due refuse the cops use the tactic of "well since u wont open your hood i can have your car towed/impounded and you arrested." Happen to a friend of mine, and myself as well except i know the law (ones i need) and chewed him out false threats, trying to bully a suspect verbally and threaten to report him to his superiors.... needless to say i was let go, but its BS how cops try and bully people into gettin what they want.

My cousin was driving my 04 Honda Civic and he got pulled over because of the sticker i had on the quarter window.. He searched the whole car, popped the hood etc There were almost 7 police vehicles there at the scene... At the end the cop says "you dont have any modifications". He then let him go...
So watch out, even stickers will cause you to get pulled over.. They are targeting EVERY CAR THAT LOOKS MODDED, EVEN IF IT HAS A "K&N" sticker

Here in GV Cops won't even look at me with my tinted windows and huge hood. i think thats how it should be, only if i am breaking the law should they pull me over.

YES, those BS quotes are EXACTLY what they do. That is the EXACT reason why you carry the taperecorder. There is no reason why they cannot let you tape record. If they don't, or if they say they are going to impound, its time to ask for his superior.
Frankly, I am tired of the BS that cops pull on kids, especially on Sunrise. Now, if the kid was street racing, and driving recklessly, I don't care if the office didn't have probably cause, you deserved it. Its the people who aren't in violation of the law who get pulled over because they have stickers, etc. THAT PISSES ME OFF!
Like I said, we do have rights, a traffic stop in my 03 Cobra is no different than a traffic stop in an 03 Tahoe. Period.

When a good attorney, such as mine, gets a hold of it, its going to get thrown out. Its still an illegal search and seizure. These aren't my words, the words of the former DA.
Let me expand however. THEY CAN STILL SEARCH YOUR VEHICLE.
You are correct in a regard. Its called a Safety Search. The officer at ANY time can decide to do a safety search to find ANYTHING on the vehicle that is of course, unsafe, or a violation of a smog law.
This safety search HAS TO BE COMPLETED IN FULL. If they fail to not complete it, it would then be an illegal search and seizure. This included, tail lights, horn tests, blinker tests, tire pressure, tread depth..etc. If the officer finds your vehicle out of compliance at that point, then YES, you are guilty of illegal modification.
An officer cannot simply just say he is doing a safety search and then ONLY look under the hood. Once again, its a violation of our rights.

i like this thread. but i "heard" that if the officer pulls you over and you refuse to let him search, that is probable cause rigght ther. so instead of refusing what do you do? ask him for what his probablecause is?

i recently got pulled over in my fox body which prior to getting pulled over the hood flew up and therefore i had to drive my CAR AROUND WITH NO HOOD. SO ANYWAYS I AM DRIVING TO WORK AT 745 IN THE MORNING THROUGH FOLSOM AND ALL THE SUDDEN I GET LIT UP BY AN FOLSOM PD F 250. HE WALKS UP TO ME and looks at the engine for about 5 seconds AND SAYS " HAVE U EVER BEEN CITED FOR AN EMMISION VIOLATION.' I TOLD HIM NO AND HE SAID WELL TODAY I WILL BE GIVING U ONE FOR YOUR ADJ. FPR. AND I WAS STUNED THAT HE USED THAT REASON FOR pulling me over so he proceeded to give me a ref ticket for no smog device. i am confused as to what i should do because it is true i dont have my smog pump hooked up but it is still on the car. i have carb stickers for evrything that is carb legal. but i even have an open air filter and bbk cai and he said nothing about this... any ideas

If you have to go the the ref they will probably check everything so even if cop didn't site you for something the ref will probably check the other shit.
The safest thing to do is put your car back to a smog legal state. I dunno what to tell you about the APFR. I know that the Kirban regulators look pretty close to stock so you might be able to get away with one of those.

That sounds like the cop just threw a name out there and he didn't know what he was looking at under your hood.
Do you have a carb number for your BBK CAI?

Well it seems if it is really going down. Over the last 2 days I have noticed many presumed race cars pulled over. Couple integras and one of the subaru things and a WS6. Been rolling the Jag so I am flying below radar. No fords yet tho

Thats definately not probable cause. A few things that have to be understood.
A Cop can pull you over FOR ANY REASON. Its all based on judgement. However, everything he DOES in the traffic stop has to HOLD UP IN COURT. That is the key.
So, an officer can claim he pulled you over for loud exhaust. That is DEFINATELY probable cause that your exhaust system is modified. It is not however, probable cause to start flinging a flashlight all up in the car, he can't search under the hood, and can't go into your glovebox, etc. The exhaust decibel level has nothing to do with illegal modifications under the hood, i.e. Fuel-Press Reg, No Smog Pump, etc. It does not have anything to do with what you have in your glovebox..get the point?
This is why it is IMPORTANT that you carry a little tape recorder around. For example, an officer pulls you over for speeding, and wants to look under your hood, uh-huh, ain't happening. Just talk to him (while recording) about what his probable cause is to search, note the time of day, why he pulled you over, etc. The more he talks about his "probable cause" the larger the hole he is digging. If he forces you to look under the hood, ask for his superior. HE CANNOT decline to be recorded. The peace officer can be recorded at ANY time. Make sure to be polite and understanding, but you HAVE TO HOLD TO YOUR RIGHTS.
All this will hold up in court. GUARENDAMNTEE it gets thrown out.
I'm definately not supporting to modify illegally and race on the streets, but if you are a law abiding citizen, NO ONE deserves to be hassled for no reason.

I have learned they do what they want... They are a publicaly supported "gang" Yes we need them but they also need to realize they arent above the law. If you got pulled over and a cop decided to punch you in the face and take your money realisticaly what are you gonna do? NOTHING! They do what they want because WE allow it. Actually it sounds like he has a decent working knowledge of smog regulations, since the AFPR is not smog legal, yet the CAI + filter are.

BBK CAI isn't smog legal in CA. Atleast mine isn't.

This shit is old in sac they have always been looking for modded cars but no matter what, people are going to mod their cars and race. Tickets are just tickets, you pay the fine and thats it...........
