Perhaps, but the argument is more of less the fact the car is 100% original, and I'm failing because of a silly sticker that DIDN'T come on the car when I bought it 10 years ago. lol

Look on your window sticker, not sure how it was ten years ago but nowadays it had to say CA Emissions Legal on the window sticker to be sold. If it says that you're safe, if it doesn't, go ask Roseville why they sold it to you.

Do know how to read Roush says was it's not carb legal. It should have never been installed on the car when was being sold in California.

Op sounds like the tech was not in the wrong if Roush themselves are telling you it is not legal. But you might be in luck, if I can find my old intake for my 2v you can use it, hell even have it.
If I can find it I will bring with me to the 50 reasons car show this weekend. Just pick it up.

You can try reading my post again. If his window sticker doesn't say CA Emissions he can get the dealer to pay for the smogs and a new intake. Because in the current day and time I can get a car from another state trailered to my dealership and sell it without CA emissions in which case I am responsible as a seller. So if his Roush didn't originally come from CA it won't always say that. Crawl back in your hole troll.

I contacted Future ford of Roseville and they basically through me under the bus. No idea how many voice mails of advisors I got, and then when one answered they asked how old the car was... 10 years?! its out of warranty and there's nothing we can do. try contacting roush and see what they do. ( already did that )
What's funny is, I went in there 2 days ago and even their intakes now don't have carb numbers on the S2 and S3 2012/13/14s...

Go talk to the general manager.service writers are like car salesman the just want you money an if that can't sell you something they will tell you to kick rocks.

I emailed roush again and they responded, and now they're asking me if the car was equipped with the Air intake from the factory or was it added on. ( Its optional on S1, but on S2 and S3, its a factory option )
They're asking for my serial number to confirm its an original roush and my vin number.
I'm supplying them with that and we'll go from there, I guess.

Lol I'm not even looking for somebody to "under the table" smog it.... its a factory car, 100% in the same condition it drove off the lot in November of 2003. There should be absolutely no reason that this is failing, what so ever.

Lol it's not a "under the table smog" it's all legit, welI maybe it kinda is since it doesn't have a CARB sticker but he runs it through the machine and all that good stuff,
