First off, I think there are several things wrong with this article. From a memorial in the middle of the street to loss of freedom of speech.
These officers' don't have a much power as they think in this country since they can't voice anything real.

Did you read the article? I'm guessing he was put on unpaid leave not because he made the statement, but because he lied to his superiors and investigating officers. That's obstruction of justice.

I think the officer realized he'd be fired and tried to change his story. Either way you know he was going to get fired just for stating his opinion. Otherwise there'd be another riot and they can't afford that.
Why is there a memorial in the middle of a public street? What happens if it snows? Do the plows have to go around this make shift memorial?

Getting fired for making the statement is speculative at best. He probably would have been put on paid administrative leave and relieved of his information officer duties, but not fired had he just come clean at the beginning. The statement wasn't that bad. Right now, he's on the bubble because he lied to an investigating officer. That's breaking the law. Making an insensitive remark is not against the law. There's a huge difference between the two.

Now, let's just say he is getting fired for making the remark. That's not a violation of his 1st Amendment right. The government didn't pass a law saying he couldn't say it. He's not being jailed because he said it. He's feeling the repercussions of saying it. The 1st Amendment doesn't protect you from being a dummy and getting fired because you made your employer look bad. It protects you from the Federal government (and through incorporation of the 14th Amendment) the State from making laws that prohibit the expression of that right. In fact, this type of speech has historically not been protected by the 1st Amendment because it is likely to cause a riot and put the public in harm's way. It's similar to how you can't yell FIRE inside a crowded movie theater.
