Hi, haven't sold a car in a while. The tranny went out and I have a CEL. I have no plan on fixing either issue. What do I need to do to sell my car as is, non operational without requiring a smog cert?

It's illegal to sell a car without a current smog certification in California.
In some cases, if you post and report that the car cannot and will not pass smog, the new owner will be cool about it. But 9/10 if he decides to throw a fit to get his money back, its almost a guarantee win for the purchaser, with the right argument.
You'd be surprised how many Nazi's are out there. I sold a 4Runner that had an expired smog certification of 3 days ( they last 3 months ) and even though I showed him the date when he bought it, and he was OK with that. He took the truck home, 2 weeks later when he went to register it, DMV wanted a new cert and because he didn't want to spend the 50 bucks and he proceeded to turn it into a legal matter. This is incorrect. File a PNO request with the DMV either online or in person ($15 filing fee), inform the buyer that it is on Planned Non-Operation, and sign the title as usual. If the buyer decides to drive the car home, tell them they need a day use permit (easily obtained from the local DMV for free) and insurance to do so legally. Legally any car sold in California has to have current smog inspection an pass it.the only people that can get away with are tow yards an junk yards.

If your car was registered non-op then you can sell it as a non-op and the buyer will transfer it in his name and get a title with no issues what so ever. I bought a 60 ranchero this way and have the title. The DMV asked if I wanted it kept on non-op, and I did.
I bought my notch with registration out 1 1/2 years and needed smog. It eventually failed smog so I'm still out of a title, but once I pass smog and submit it to the DMV, then a title will be mailed to me. The person who sold me the car is not in jail or in trouble in anyway. I just don't have a title at the moment to transfer if I wanted to sell it.

I bought my 91 coupe and it's non ops. He had the title but gave it to me but I have told him do not send the paper that's attach to the pink that says he has sold it , so I told him I'm going to smog the car when it's all said and done so we could both go to dmv and tagged up my bucket up!

If the vehicle fall under smog inspection guidelines it has to have a cert smog certification to be legally for sell in California. But you can sell any car anyway you want if dude wants to be a dick he can make pay to any an all smog repairs that is need.

The car is not registered non op. I cancelled the insurance though so my insurance is going to notify dmv. Do I have to contact dmv to change it to non op and then I can sell it as non operational?
