Technically he wasn't arrested, only detained, so I think you'd be hard pressed to win a suit to win monetary damages against the department.

Yea. Probably couldn't sue. But I would call the sergeant every day and ask him "what are you doing today to avoid mistakes like you made with me?" "Have you hired more competence?"

I thought at first they arrested for giving money. That would be a great law! Every corner in sj has a homeless person asking for money.

Who did he file a complaint to..the police? If so that is already in the trash pail. He should get a lawyer and at the bare minimum be compensated for the damages to his car/time wasted on the side of the road. Thanks for that logical response.
I love how people on here act like the law can do no wrong, BUT if that happened to them it's a problem.
There's no way around the fact that the police F@@ked up, we should all be able to agree on that.
