Topic: Need help with an accident I was involved last night.update

Ok so story short me and my sister were driving on tully as soon as we pass the next main street some couple runs a red and clips us in the front we spin 4xs and hit the divider my sisters truck was totalled. Ok my question is my sister insurance called me today they can pay 5k in medical bills but as soon as we come to a settlement with the other insurance we need to pay back all the money used.ok what should we do I say we get a lawyer and get legal I mean we cant loose they ran the red light and we have a witness that saw everything. Do not get an attorney! They take almost 50% of the settlement, my wife and I were in a accident last year and settled ourselves by doing research online. We ended up getting a very big amount and were very happy with settling it our selves. Attorneys do the same shit and take most of the money...imo

Get a lawyer so in the end he can make sure you don't pay out of pocket for any type of fees. They ran the red light, they caused this all to happen so they're insurance should pay for everything.

It's your insurance company's responsibility to contact the other party's insurance to get back the money they give you. Every time I had an insurance claim, my insurance companies always took care of me and I never had to do anything but take the car to the body shop...
Does your sister have a low cost insurance company? Sounds like one of those Eastwood type insurance deals...

No its a statefarm branch...but they just want to help us cover or injuries but what should I do take their assistence or just wait to see wat happens my back is kinda hurting I just want to know what are my options...

my wife is a paralegal for personal injury she seen this all the time she is the one that deals with the insurance you can do it your self any questions lmk

You need to get checked out asap. You also need to keep detailed notes from now on out. 1) mileage driven to doctors 2) time spent getting medical help Etc etc every bit of info that can be used and counted toward "compensation/pain and suffering"
My HR manager who's a paralegal was rearended. And I've seen what she's gone through. Keep your patience because it'll be lengthy.

In a situation like that I went to doctor for 4 months and got like 4gs that's all so get a lawyer for something that big!!!!

First off if you get an attorney they take minimum 30%.
With your med payments that's how insurance works. They pay for your bills and when you settle you pay them back what they paid.
Go to the doctor and what not. If they are 100% at fault you can get all missed wages, pain and suffering, medical paid, co payments. Whatever you do, don't settle until you are done treating with a doctor. [ December 30, 2011, 06:24 PM: Message edited by: adower ]

Uh how insurance works is nobody gets a dime until everything is settled and that can take from 10days to months
so your insurarance is actually helping u with a 5000 intrest free loan.Take the loan to help now for transportation and meds. Keep all receipts gas, mileage, time out of work and dont forget pain and suffering.
Looks like youll be driving a cobra in no time

Wow reLly frank I guess ill have to get you some mods with my settlement cuz thnks to you I was in the accident And its not a loan its a medical bill loan you can say. nothing like a cold beer to get rid of the accident stress lol...

You have the upper hand here. No need for an attorney. Do all the research you can an like everyone else has been saying keep track of everything. You are in a position here where you can squeeze as much cash out of their insurance. Take the 5000 if you need them. You should be getting a lot more then that in your settlement.
What insurance did the other driver have?
Tell them since the accident you have been unable to perform in the bed, they will cash you out for your troubles lol I've just heard a lot of stories people have reported and have gotten a cool amount of cash

He was already having trouble peforming in bed before the accident so i dnt think thell cover that.

any medical checks you do, present the billing department with the insurance policy number of the at fault driver.
when I was in my accident I got checked out and went to a chiro for about a year, and had a rental car for a month. I did not pay for anything out of pocket and they never took a credit card from me/etc. All I gave them was the policy number of the at fault driver and billing was handled for me.

Dude make sure u get checked out and sister get all the medical attention u need just because you hear dollars signs dont mean you can instantly come up on the car crash...saftey first make a list now of all the expenses their insurance will pay as soon as the police report come out trust me that they will be at fault. I would clian pain and suffering and stick it hard to their insurance company.....dont back down. Remember " nobody can tell you that your not in pain...its subjective evidence which means me or ur doctor or insurance guy cant say that ur not..and if it affects your work or ability to work you get paid.

Quick update went to drs on monday he said I need to take a month off I said no he gave me stupid dirrections that no employer would follow work 1hour rest 15 min and cant carry over 20lbs I said ok ill take 2weeks so now am on a 2 week disability leave how does that work where do I file? I'll see my dr today aswell..

you have to go through unemployment and get the disability paper work. you fill out a section and your dr fills out another, and your dr has to mail it. got hurt dirt bike riding last year and was out for 3 weeks and that was the process I followed and it worked out great.
