AT&T has started to issue warnings to customers unofficially tethering their smartphones to its network. In an email to unauthorized tetherers, the company writes, “Our records show that you use this capability, but are not subscribed to our tethering plan.” The correspondence goes on to note that users will be automatically enrolled in the $45 per month “DataPro for Smartphone Tethering” plan if they ignore the warning. “The new plan – whether you sign up on your own or we automatically enroll you – will replace your current smartphone data plan, including if you are on an unlimited data plan,” the email continues. The standard DataPro offering is $25 per month and provides users with 2GB of monthly data, although some users are still clinging to a discontinued, $30 per month 5GB data plan. It is safe to assume that a large portion of the unofficial, tethering populous is jailbroken iPhone users and rooted Android users. “If you discontinue tethering, no changes to your current plan will be required.” A copy of the email tethering-cheaters are receiving is after the break.

Good luck with that.It states in the terms of service of every major carriers smart phone unlimited data plans that if you abuse your data or "free tether" you will be removed from the plan.
This is old news and has been going on for a while not just with AT&T.
Tips for AT&T users with iPhones or Android devices weather your rooted/jailbroke whatever all you have to do is make an adjustment in your APN settings to avoid being detected for tether use.

its actually a blind message theyve sent to those that have high data usage so they are not specifically targeting jailbreak users and have no way to tell. read modmyi.com

Ohh cool see thats what I meant they can't tell if your teathering or just using alot of data so how is it ok to just assume your tethering and change your stuff without notice

I only tether to send and receive email and I haven't gotten the notice yet. I suspect it's only sent to heavy data users.
As a side note...back in the day, tv cable companies required you to pay for every TV connected. When set top boxes were required, this was easy. But, when cable-ready TVs came out, the companies had a hard time collecting fees. So many people spliced the coax themselves (against the rules) that they finally gave up and realized how futile it was. Civil disobedience can work.
