my buddy bought a car off a used Hyundai lot a 2000 something crown vic (former cop car) and he put 800 down and finaced it....gets call from dealership today saying they need to talk to him AND TO BRING THE CAR...turns out the bank declined the loan and the dealership needs the car back...is my friend covered for his 800?? what rights does he have in this position? thanks

If he doesn't take it back, the dealership will most likely report the car stolen and your buddy will go to jail cause his loan didn't go through and he doesn't own the car.

He should, if not have him call the cops and have them file a report that he was robbed.

He will get his $800 back and yes he has to give the car back because on the contract he signed there is a spot that gives the seller right to cancel if the loan does not go through

Sounds like the dealership did what they could to try to get your friend financed, but your friends income and credit probably is not very good.. Trust me the dealership and sales guy did not want to have to call your friend back to give up the car.. For them it was a no sale and that means no money for them from your bud.

He will get his money back 100 percent regardless of what he put down. this is a gray LINE and he can fight it, but its easier to return the car. He signed documents saying he bought the car, dealer can't repo or report it stolen! Actually he can tell the dealer screw you, I'm keeping the car, since the dealer had him sign all the legal document... they do this so you can't go else where and buy a car, they lock you in, but on the other hand, you can keep the car. If he keeps the car, I'm sure the dealer will try to go after him in court.... "GRAY LINE".
All dealers do this, and if the loan doesn't go through people bring it back. I have worked for many years for used car dealers. If your friend really loved the car and doesn't want to give it up, he can contact the DMV investigators office, this is where you complain about dealers. He can tell the dealer that I'm contacting the DMV investigator to ask for the law.
Dealers SHIT them selves when you say the work DMV investigator...
