But the owner never registered it to his name and the old owner's signature is on the title. is this a red flag or what can i do to buy it legally? any help is appreciated.

Walk away. Unless he can get in contact with the last owner and bring him along to sell the vehicle so you can see his id matches the paper work

If the seller is legit I would just have him sign a bill of sale from DMV just in case the previous owner sent in a release of liability but I've been through this and everything went smoothly.

Can't title hop, it's illegal and dmv will not let you register it.

Honestly, this is what a bill of sale is for. Just have whoever is selling you the car full out a bill of sale and when you go to the DMV tell them you bought the car from this guy but he never registered it in his name.
On another note, I'd make sure there were no back fees.

I have also , no bigggie . Maybe he just bought the car and decided to sell it asap rather than having to wait a month for new title. As long as the bill of sale is in his name , you should be safe . I ve sold a bunch of cars under similar circumstances.

Ok so ill print out a bill of sale to do it, but will the dmv charge any back fees or the taxes the owner didnt pay?

Yes. If there are back fees that will be your responsibility unfortunately. I'd get the vin number and check for yourself before buying the car, going to register it and finding out there are 100s in back fees. Atleast if you find out first you can work on price.
Only other fees will be a standard transfer fee.

when buying a vehicle, you only need two things...bill of sale and pink slip. doesnt matter who its registered to. some dmv's might give you problems but it all depends on whos helping you. ive done this numerous of times and only a few times did i have any problems.
