Yes. Page 5 of this handout shows it is:
http://www.epa.gov/oms/regs/im/roadside.pdf
The BAR greeter also provides the driver with a consumer information handout (Appendix D) that further explains the Roadside Inspection Program. If the driver agrees to participate in the inspection process, the vehicle is inspected. If the driver refuses, the vehicle is released and another vehicle is quickly directed into the test lane. The license plate numbers of vehicles whose operators decline to participate in the Roadside Inspection Program are recorded and entered into a laptop computer for later analysis.

wtf does that mean, lol.
Lee, good looking out. If anyone can, snap a few pics of this set-up. If I didn't have work commitments, I would go out there and snap a boatload of pics and post it on every forum I can think of.
It sounds like this BS is popping up in Concord multiple times now.

Sounds like our better off just doing the test right there. The reason I say that is ur gonna be in the black book like in casino. they might start having you smog your car more often or even show up at your house and check out your car.

for what I know is that every car tested at the roadside smog check, the results are later compared to those of what's on the system of the same car when it got smog by the owner, they do this to cracked down on the smog places if there's a significant difference than they'll start investigating the smog check place where it got smog by the owner, and it is "optional" but if you refuse you get entered into the system as a refusal and yep you get more frequent smog checks. ![[BS flag]](graemlins/bs_flag.gif)

These days it's easier to just be smog legal and not have to worry about anything or just get a smog exempt car.

Lee, how were they pulling people over? Does CHP waive you down?
And has anyone see one of these road-side smog ambushes at night?

I am going to print out that PDF and keep a copy in the car with the "voluntary" highlighted, lol.
Does anyone have a more recent copy of that epa roadside smog information? [ September 09, 2010, 01:59 AM: Message edited by: Luke87GT ]

addendum
http://www.bar.ca.gov/80_BARResources/02_SmogCheck/addendum_with_report.pdf
I have had a chance to read through the initial intro document by the EPA from 2000 along with the addendum. Unless things have changed, here is my impression:
1. This is a voluntary test 2. There is no negative impact to the user regardless of the outcome of the test 3. The testing began in 1985 and is used to gauge the effectiveness of current smog protocols and keep smog stations honest, not to single out individual users. 4. The results truly are staggering. Of all pre-OBDII cars that fail a smog and then pass within the same smog period, the mobile smog program found that nearly 50% of those cars fail the mobile test within a year. That tells you fraud is happening on an epic scale and this is a tool to catch those kinds of "bad-apple" smog shops.
At the same time, if you roll up there with an off-road h-pipe and a JLT CAI and fail smog, do they just let you go with no penalty? Maybe, but I am not so sure.
I am 100% for smog checks in the state of CA given our population, but it has to make sense and people can't be failing for air-tubes or filter elements, come on!
Smog should be a tailpipe only test. Let's cut through the beauracracy California! [ September 09, 2010, 10:36 AM: Message edited by: Luke87GT ]

It never has made sense that your car can pass the sniffer, but they'll fail you if you don't pass visual.

Selective sampling is an often used political trick. For all we know, four cars fit that category and two of them failed. That's gets you 50% right there. Percentages mean nothing without the actual numbers
