I sold a car about a year ago. The person i sold it to never took it out of my name. i signed a release of liability on the car. I was wondering if there is any way i can get the car back? Is it still my car? Also would they get in trouble not transfering it into their name?

yes you can take the car, then go to dmv and take the release off. people sign releases some times when they lone out there car, but you can only do this if he has not registerd the vehicle yet.
why did you sell your car if you are just going to steal it back???? [Confused]

No you sold the car. All he is guilty of is not transferring the title, wont get in trouble he just pays a penalty for not tranferring it within 10 days. Only thing I can say, is if the car gets towed or something like that. They will ask you if you want the car. And....try to stick you with the tow bill. but if you released liability then you are all good.

Only thing I can say, is if the car gets towed or something like that. They will ask you if you want the car. And....try to stick you with the tow bill. but if you released liability then you are all good.

thats funny i sold a car bout a year ago to a guy who SAID he would pay me for it later so i KEPT the pink slip till later, that is signed straite to me.an i got a freind who is quite close to this scoundrel,and i think he did a vin swap or maybe not, but the car is still around bein fixed up,just waitin for it to hit the street an all hell is gonna break loose and im gonna get a runnin car back,is that wrong?he stole it from me but i wasn,t dumb to let the paper work go.release of laibility is a signed thing, pinkslips are a signed thing that yes if investigated they check signatures all in dmv history.and all punishable by law, .if what your saying is true,u sold the car thats that.and thats that.your tryin to get it back now? how?theft?this your first post and u got questions like this.hope he didnt sell your my car and this is a backwards way of you seein whats gonna happen if so, u should pay the 300 thats owed to me.and if im barkin up the wrong tree, only legal way to get the car back is if the car is impounded and all registerd owners get a letter and u need to respond and pay the tow and hope no one contests what your doin.sence u SOLD IT.

I sold it to a guy who never transfered it to his name. than he sold it to a guy who still never transfered it to his name. no pink slip was ever signed over just a writen bill of sale that im 100% positive the first person i sold it to doesn't have anymore. and they never wrote any bill of sale when they sold it to the second person.

Now the car is just sitting there in a driveway and never moves. I want it back. Can i just get it?

So even if they wanted to they couldnt get the car out of my name.. right? they have no bill of sale or pink slip signed over to them. the car is just collecting dust. i want it back cuz i can do so much more with it than have it collect dust. and if i can get it i will.

I see jail and or a good ass-whoopin in your future. This is so damn shady its not even funny. So what they did not transfer the car? You released liability that is all you should be worried about. They will ask you why did you release liability. Then what are you gonna say?

Some of you are displaying poor judgment and mentioning unethical alternatives with serious consequences. Most of you are speaking of fraud as opposed to grand theft auto. Fraud will usually be a felony whereas grand theft auto can be a wobbler and be charged as a misdemeanor; however both are against the law, but if you hire a good attorney you might just get away with it.

IMHO: Even if you could get away with it (no jail and free car) the attorney fees will outweigh the benefit of getting your car back. Although you may win a case you may come out loosing at the end. This is why 99% of defendants in civil court pay out even thought they know they will win the case: the attorney fees are more expensive than the case winnings (in this case your ex-car back)..


In criminal court however; you have a 1% chance of winning. Here are the facts about criminal court cases: 95% plea guilty and the remaining 5% are a mixture of celebrity cases like Scott Peterson, OJ, ect… Some are also the rare and unusual insanity pleas. The rest which is are the average folk that neglect to plea guilty will lose almost always. Sorry, but it’s true and factual.


I had a Public Defender professor for white collar crime class and he said his promotions and raises are based on how many people he can flush through the legal system as quickly as possible (guilty plea). He also mentioned his contemporaries (Prosecutors) get promotions and raises based on how many defendants they convict. This is in Santa Clara County, so not all counties behave the same way. It is all arbitrary and open to interpretation which is why lawyers have to be evil and smart and argue for you for a nominal fee of course.

Bottom line: Don't do it and don't even think about doing it, but if you do get in vine get a private attorney who specializes in what you are being charged off. This is not a one size fits all. Did I mention don't do it??? [Big Grin]

All you control is the release of liability. Thats it. You have done your job. They get caught driving a unregged/suspended reg car thats their bad and potentially your good, because only the registered owner can reclaim the car.

They can get it out of you name, believe me. Long as the car isnt reported stolen they will be successful transferring the car long as it does not get towed.

go to the dmv website and do one over the web. it let you print a copy also. do a release and print and you will be good. keep for your records.

My dad had a 70ish Pinto, and after 20yrs of ownership sold it. The new owner never put it under his name and it got towed several years later. My dad got sent to collections for $1,000 plus for the towing fees and storage because he was the last registered owner. He was in the process of purchasing a house in 1998 when he discovered this. He had 2 choices..

1. Pay the collection notice and move on with the home purchase (The bank wouldn't lend unless it was payed or solved)...

2. Go through 6 plus months of waiting, untill DMV got together with the Credit agency, which then would get in contact with.....ect.

Remember I said when you win you might loose. My father knew eventually he would be cleared of the 1k dollar charge off, but the chance of loosing the home of his dreams was more relevant at that particular time. He lost the 1k dollars, but at the end won the home of his dreams. My parents still live there today; so ultimately it was worth it.

My advise is to go to DMV and speak to them directly and tell them what is going on. Be advised: the bigger the beauracracy the harder it is to get things resolved. No easy answer.

The way I'm reading it is the OP isn't worried about the car not being transferred out of his name, he wants to find out if there's a loophole for him to go get the vehicle back. The only way you can get it back legally is either deal with the people that have it now or deal with a tow company if they end up with it. The tow company will notify you, the legal owner, if they are going to lien sale the vehicle and you have the option to pay the fees and get it back. In most cases its cheaper to let them finish the lien and put the car out on the corner for sale, then go buy it back for a few hundred bucks. No matter what you have no right to roll over there and just take it back.
