I have a 90 gt with a ton of work, i'm just tired of having it around and never driving it (i moved to sacramento over a year ago and i've put 300 miles on it since then)
It has your normal full exhaust, heads, cam, intake etc. It has cats but i know without paying someone off etc, it wont pass the sniffer.
Anyway to get it out of my name without a smog cert?

Check out the DMV site. Your are 100% liable for smogging your vehicle when you sell it.

i dont think that's true. i'm pretty sure you can sell a vehicle and not smog it yourself UNDER THE CIRCUMSTANCES that both parties agree and that the buyer will smog it. correct me if i'm wrong though somebody..

You can do it that way, but they can still come back and hold you accountable after the sale... even if you have it in writing that the buyer is responsible for the smog. If someone wants to make a stink about it, they can legally do so. [ November 13, 2006, 02:28 AM: Message edited by: iceman302 ]

I always put car is for parts on the bill of sale. You cant smog parts...

any vehicle being sold in california needs to be smogged. there are 2 things the seller is required to do smog and have working safey equiptment(brake lights and things of that nature). I think you can get by with selling it for parts only but they may issue you a junk title.

I've sold DOZENS of cars in the past without smogging them. Hand write a bill of sale and make an exact copy signed by each party. State this vehicle will not pass smog and is sold for parts only.
It'll be tough getting a good price however when you sell it like that. That's a tool I've used to get a car for a lesser price as well.

I bought my 95 GT "As Is" No Smog cert or anything.

You can sell the car as an "Off road Only" car. This should excempt you from having the smog issue came back to you, but the law states that you are "Required" to smog the car.

you can sell it.you just have to tell them as is and it will not pass smog due to what ever it is.
i have sold cars with out smog,but if they dont pass you have to tell them.Or just write a contract telling them it will not pass and keep it in your records for the future.

a lot of people sell there cars that way. If a buyer wants to be a real jerk he can void the sale though. He would have to go to court but the buyer would win.

I have sold planty of mustangs with out smog and have even bought several mustangs with out smog cert, ya you get little bit less for them but you can still sell it. YOu just have to make sure you write on the bill of sale "SOLD AS IS" "BUYER IS RESPONSIBLE FOR SMOG" and don't worry.

i bought a 88 gt once no smog cert, no title, used bill of sale, the dmv gave me a temp regestration, and no title till it was smogged. never got a chance to smogg it, totaled it(rainy night,bald tires,and taco in my hand).

He knows that you cant smog a rolling chassis, just if you sell a running vehicle you have to smog it. My friend picked up a 93 Firebird and the guy put clearly on the bill of sale that it was sold as is and buyer takes care of smog but told him it would pass. My friend couldnt get it to pass so he took the guy to court and got his money back plus what he spent trying to smog it. If you get dragged into court over a smog issue then your usually fucked.

Modular, just to help you out in the present here is the vehicle code:

Here is some more info:
Q: Who is responsible for obtaining a Smog Check when a vehicle is sold? A: Section 24007 (b)(2) of the Vehicle Code states it is the responsibility of the seller to provide a valid smog certificate at the time of delivery of the vehicle. There is no provision in the law to sell a vehicle "as is." back to top
Q: I just purchased a vehicle and the seller did not provide a Smog Check. The vehicle needs expensive repairs in order to pass. What should I do? A: Go back to the seller, inform them about Vehicle Code section 24007 (b)(2), and try to work things out amicably. If that fails, you have the option to pay for the repairs and the Smog Check yourself, and then take the seller to Small Claims Court to recover your costs. Although the law clearly supports the buyer, collecting on a small claims judgment can be difficult, so the amicable solution is usually best. If the seller is a state-licensed auto dealer, buyers have the additional option of filing a complaint with the DMV, which regulates new- and used-car dealers. back to top
I am not sure how they would handle a rolling chasis. Dont think you would be driving on the road. Not sure what would happen when a engine is put back in.
