The video I have sucks. I did see another guy with a video camera tape this incident. Maybe he can put it on this post. Any ways, this cop impounds a vette from hearsay in a private parking lot. Is this even legal?

I think if they have probable cause its legal.

Now let me just say that I am not 100% sure but this is what I think happened. I think cops got a call that the vette was speeding on the freeway and some ass called it in, almost causing a wreck to just get the vettes plates. So we are all chillin in the parking lot and that is when he starts herassing the guy with the vette. At first it looked like they were trying to spook us from the parking lot but nobody left. Finally after driving around in circles they get out and mess with this guy.

My question is, can they even do anything if the cops personally did not see anything. I think this guy in the vette has a case, unfortunately he has to get his car out of the impound first. !@#$@#$ cops

Very true.....The cops were in full force tonight. There are some cool cops around, but this guy was lookin for a car to impound.

if it's chip then it ended up not getting towed and impounded. apparently since he was in the car only a POLICE officer could have towed him, not CHP.
Posted by 95GTConvtACE (Member # 6399) on
:
I didn't stick around to actually see the tow truck, but he was told to get all of his personal belongings out so that they can tow it.
Posted by eljefe (Member # 1753) on
:
ya check out sacstangs, he posted up that he didn't get towed and impounded, technically they couldnt do anything to him.

they were gonna tow it for expired registration but after showing THEM the definition of the vehicle code and calling a seargent out they realized that it would have been ilegal for them to tow my car so they didnt tow it

where can I find one of those books? Do they sell them to the public?

i don{t think cops can do anything about traffic infractions they did not witnessed.
a long while back i was racing someone by my house.. well.. someone called the cops. we had pulled over further ahead and were just chatting when a female cop found us.
she got out and asked for ids. and told us straightup that someone had called them about a green and black convertible mustang racing, she said. i'm not stupid, i know it was you guys, but there is nothing i can do becuase i did not witness the race. just tell me if it was you so i can make my report. we talked for a little while.. she tried to scare us aoubt how it is a misdeamenor to race and we could have our cars taken away etc etc.
anyhow her back up came by and told my friend that his tinted windows were illegal, but we told him that he was not driving the car so he could not do anything. i did not have my license with me either, eventhough i was standing next to my car and putting the top down, they couldn't give me a ticket for that either, becuase i wasn't driving it or in it when she pulled behind us.

You can get them at the DMV, I think they are $6 if I heard right?

I found this online:
http://www.defend-me.com/California-Vehicle-Code/
I believe it is the complete guide that you can print up. Might take you a while though.

Posted by archersgt (Member # 5177) on

Yeah, it can happen.. All they have to do is have the person that called it in testify in court.

you can not be charged with anything on heresay evidence. they may investigate the case. but i can not go to jail because someone said i was doing something illegal.

The cops are cracking down big time. 3 weeks ago I got a "no front plate, tinted windows, modified emmisions" ticket. And exactly 3 weeks later I got pulled over again for a "no front plate and too big of a hood' ticket. Yes too big of a hood. Both times I was not speeding or doing anything wrong. I was also in 5th gear doing about 45 both times.

WRONG! I got my car impounded and got cited for wreckless driving for that. Ive heard of others having the same thing happen too.

thats because the owners of the lot/property either called the cops, or authorized the action.

Yes.
26708. (a) (1) No person shall drive any motor vehicle with any object or material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows.
(2) No person shall drive any motor vehicle with any object or material placed, displayed, installed, affixed, or applied in or upon the vehicle which obstructs or reduces the driver's clear view through the windshield or side windows.
(3) This subdivision applies to a person driving a motor vehicle with the driver's clear vision through the windshield, or side or rear windows, obstructed by snow or ice.
I'm guessing this applies to section a2, but you could fight it if you try. It depends on how big of a hood rise you have, take pictures from eye level out the windshield, also measure from the seat back and butt cushion to your eye level. Go fight that crap.

The hood is 3" but I already "fixed" it.

Cool, but did you see he check NON CORRECTABLE offense. It means, you fight it, or pay for it. Fixing it and sign off won't work in court.

No, my friend worked there at the time and he and the managers would do shit like that after their shifts. when i was there we got the OK from the managers first.

You can get cited for reckless driving (23103 C.V.C.)in a public parking lot or a private parking lot where patrons do not have to pay to park (i.e. mall parking lot). Under California law, this is known as an "offstreet parking facility", as defined in subdivision (c) of Section 12500. If you piss off the officer enough, he will have you appear before the magistrate ("arrested" ). In this case, he can impound the car incident to the arrest.

Actually, all the property owner has to do is post near an entrance a sign stating "cvc (ca vehicle code) enforced" then the cops have every authority as they would on the street.

They can pull you over for ANY fix it ticket violation anytime they want. It's just another excuse for them to check you out and make sure you're not doing anything wrong.
I got pulled over a couple of times for tinted side windows but have not been harressed ever since I got the tint removed.
When I had some older cars I was pulled over for front license plate, broken tail light, etc.
It sux and is such a waste of time
