San Francisco Voters Approve Handgun Ban

Voters approved ballot measures to ban handguns in San Francisco and urge the city's public high schools and college campuses to keep out military recruiters.
The gun ban prohibits the manufacture and sale of all firearms and ammunition in the city, and makes it illegal for residents to keep handguns in their homes or businesses.
Only two other major U.S. cities — Washington and Chicago — have implemented such sweeping handgun bans.
With all precincts reporting early Wednesday, 58 percent of voters backed the proposed gun ban while 42 percent opposed it.
Although law enforcement, security guards and others who require weapons for work are exempt from the measure, current handgun owners would have to surrender their firearms by April.
A coalition led by the National Rifle Association has said it plans to challenge the initiative in court, arguing that cities do not have the authority to regulate firearms under California law.
The military recruitment initiative won with 60 percent in favor and 40 percent against.
The measure, dubbed "College Not Combat," opposes the presence of military recruiters at public high schools and colleges. However, it would not ban the armed forces from seeking enlistees at city campuses, since that would put schools at risk of losing federal funding.
It encourages city officials and university administrators to exclude recruiters and create scholarships and training programs that would reduce the military's appeal to young adults.
"We now have the moral weight of the city behind us, and it's definitely a valuable asset to have in our corner," said Bob Matthews, an activist for the proposition.

How can this be so, You would think that this ban would be unconstitutional. States can make their own laws and whatnot as long as they do not interfre with what is written in the United States Constitution. In the end the US Constitution is the Law of the land, no ifs and or buts about it no matter what state you live in. The Second Amendment allows Americans to bear arms. As an avid gun enthusiast and multiple gun owner, i resent the statement relating gun owners to rednecks. Why should i have to live in texas to own a firearm. All of my guns are legal and registered, and all of the except my .357 magnum (on my nightstand with a trigger lock) are safely locked in a gunsafe. With all of the crazy fukks out there not only do i think it should be legal to own guns, but also to carry them loaded. Youre right it has no effect on me as i live in san jose, but if sf can do it what makes you think other cities wont follow suit? No hard feelings, just my $o.o2

Rather than banning handguns, to me, the right thing is to enforce the laws that are on the books. I remember about 20 years ago, maybe more, there was a law about using a gun and going to jail. I don't know if that is still a current law, but it should be enforced, and stronger. If you use have a gun when commiting a crime, whether or not you use it, and you're found guilty in court or by admission, than automatic life in prison, no matter of your age.
Oh, and they'll need to build more prisons. I like that Sherrif in Arizona that uses tents in the desert. If every juristiction used the same ideas, crime would go down. Just my thoughts.

I agree with the prison time thing. 99.9% of gun owners dont use their guns in an illegal way. its the punk ass gangbangers that do that kind of crap. Fukk a desert tent prison, lets re open alcatraz!!!

NO hard feelings whats so ever, we are all just stating our opinions. Personaly I really dont have a problems with guns, I myself do not own one but I have thought about getting one. But what can you really do, The legislature went to a vote by the people and won.... That is the way america is, It is not like Arnold just went out and said YOU CANT OWN A GUN, the people of SF voted on it. That is the point Im making. If you live in SF and own a gun and didnt vote, then that is your fault and nobody else.

I agree with the first two points, especially the second. so what if a majority of voters voted for it, it's still in direct conflict with the Constitution. which is, last time I checked, the highest law of the land, and no state, city, or county laws can conflict with it.

Well technically they can do this providing they use "due process" I believe. The question is does a vote like this count as "due process?" Just thinking out loud...I own several guns (handguns, rifles, shotguns, etc) myself so I think this law blows too...
