This is one of the reasons it is a misdemeanor to bring O.C. into a custodial facility, and a felony if the O.C. is discharged without authorization. It is difficult to tell from the quality of the video whether the "student" was passively resistant (i.e. not complying with officers commands) or actively resisting. The officers are authorized to use that force which is necessary to overcome the resistance of another and to effect the arrest. If the policies and procedures of the UCLA Police Department authorize its officers to utilize a tazer against someone who offers passive resistance (mentioned in a newspaper article), then there is really no issue. At the very least, the "student" could be charged with Trespassing (602 P.C.) and Resisting, Delaying, or Obstructing an Officer in the Lawful Performance of Duties (148 P.C.). [/QB][/QUOTE]
