Honestly, I don't think you should give him the money back if you decide to take the bike. Look at it this way. When you go out and finance a car, you have monthly payments. When you can't afford it anymore and you don't pay, they repo it. In that situation, you don't get your previous payments back. You're in a position to act as a private Financier. You're the one who is handling the relation between the money and the product. You have a contract. I would assume that nowhere in that contract does it have a "refund" clause. Therefore, your legally sound in taking the bike back and returning no portions of the money. Its all a matter or morals at that point. Good Luck. Just my 2 cents..

The best thing you can do is to accept it as a mistake ON YOUR part, learn from it, and move on with your life by never financing anyone again.

well when i went to collect last week he said hed be here friday for sure(which was yesterday) and he did not show or call....so i plan on going over there when it clears up or slows down and if he does not have the money im going to get it back
