I recently received the verdict on a Trial by Correspondence for a photo enforced red light system that captures your picture when you don't STOP, THEN TURN RIGHT. It's guilty! I lost $400 bucks. It does not say more. Just guilty. Is the corresponding judge supposed to follow protocol by explaining why I was found guilty? Was he/she supposed to explain that I'm guilty for the following reasons which is...no explanation. Therefore, may I request a new trial based on that? A judge would tell a criminal they are guilty of a crime such as: drugs, assault etc. There's no explanation. It says guilty. I'm just trying to find a loop-hole here. Help me out. Thanks. By the way, it's a pay-the-fine-first-then-we'll-listen-to-your-side-of-the-story trial. Everyone pays first if they were to contest the citation. You already stated why your guilty in your post.
You didn't fully stop before making a right turn. Law states that if the light is red and there no yield sign then you treat the turn as if a stop sign was there.
Basically the camera is setup to catch people who don't come to a complete stop before turning right. A lot of people don't know that you have to come to a complete stop. Some people come to a complete stop when there is a yield sign and it pisses me off, lol.
The camera caught you red handed. Unless you can prove it wasn't you driving (hard to do when your in the picture) or you prove the camera is malfunctioning (also pretty damn impossible) your probably fucked and have to pay the fine.
I'm sure those things need to be certified every so often, it may behoove you to check and see how recently it was calibrated, if they need to be calibrated that is. [ November 12, 2010, 03:57 AM: Message edited by: 90FoX ]

Not really sure about the expiation part. What I do know is that your given a second chance by "Trial De Novo". Request that in person or by mail. You will then be given a chance in person this time around.

Listen here Bud,
You are guilty because you didnt stop. Simple as that!. If you would like an explantion you would have to go to court from the begining of the case.
Now the only option you have is to pay the fine and find out if you are eligible to attend traffic school.

I went to traffic school and they said the only thing they will do is reduce the fine if the judge is nice unless it was someone else driving in your vehicle then they can void it

It's just easier to not run a front license plate so they can't track you down.

what you got to do next time take the pic they send you and go copy the and keep copying the copys till you cant see your face because they send you the original pic they dont have a copy worked for me

That must be from county to county record keeping. Because a buddy of mine thought the samething when he received his papers and claimed it wasnt him and the judge had a full sized one in front of him showing he had a cigarrete in his mouth and a oh shit look on his face . LOL, so I wouldn't try that
