Hey guys just wanted to see if any of you work with insurance companies or have recently been involved in an insurance accident settlement, basically my insurance adjuster is being a real ass and beyond calling an attorney even though I hate them I don't know how else to proceed.

Background: I was involved in a hit and run about 18 months ago, my car was totaled (they paid me full price and them some for my cobra so I can't complain). As a result of the accident I suffered a herniated disk at L4 L5, another disc issue a little higher at T10 and 11, have pretty much daily back pain numbness and tingling in my legs and have to take three different prescriptions. Although I am feeling way better then I did and things seem to be looking up it's still a pain and it's affected my life big time as well as jobs that I can't now apply for the time being. I have paid for all my medical appointments with my own insurance through Kaiser.

The question I need answered and I know that it's not black and white is what is a fair settlement to ask for? The insurance lady basically said she's willing to pay me for 6 months of medical and pain and suffering even though I've been dealing with this crap for 18 months?? If she's offering me a few grand what do you realistically think she's willing to pay and settle for? My insurance policy has a $100,000 uninsured motorist amount and I know I'm not getting the full amount it's not like I was paralyzed or anything. I know I'm not going to accept her first offer but what's you opinion on what's reasonable?

Any opinions or ideas would be great, thanks all sorry for the long ass story.

Get a lawyer.... Let them deal with it. Also look into keeping the medical records open. As in don't let them tell you, you are fine bc you are fine TODAY! Things change and if you're still in pain 18 mos after imagine 18 years!

Thanks man that's what scares me she's like oh you're getting better so the pain and suffering is over but what happens if it gets worse down the line.

You should atleast get back what you have lost in the past 18 months plus something extra for pain and suffering. If they keep trying to not pay you whats fair then I'd get a lawyer to fight for you. I hear there are some that don't take a dime from you till the case is closed. I haven't had an experience like this one but I think this is the best way to go about it.

Why would insurance pay for your pain and suffering???? They cover your pay and expenses but pain and suffering is something you should sue the person who hit you for. Insurance didn't cause you pain and suffering.

That makes sense but I think if insurance pays you for pain and suffering, then they go and sue the person who hit you to get back their losses. I've heard this many times but like I said I don't know much since I haven't had an issue like this

I'm not that pussy lol just wonder what's fair here and since it was a hit and run they have no one to go after they are just paying me out as their own client.
