A Virginia man spent four hours in jail after purchasing a Chevrolet Traverse from Priority Chevrolet in Chesapeake, VA. The dealer's sales staff accidentally sold the SUV to Danny Sawyer for $5,600 less than they should have, and when Sawyer refused to sign a new, more expensive contract for the correct amount, the dealership called the local police alleging the buyer had stolen the vehicle. Law enforcement then picked Sawyer up and held him for four hours before getting the situation straight.
Dennis Ellmer, president of Priority Chevrolet, says he owes Sawyer an apology on behalf of the dealership, and had intended to do right by the buyer by letting him have the vehicle at the agreed-upon price. But Sawyer's lawyer says it's a little too late for saying, 'sorry.' The briefly-incarcerated owner has filed two lawsuits against the dealer, accusing the business of malicious prosecution, slander, defamation and abuse of process. All told, the suits seek a total of $2.2 million in damages, plus attorney fees.
That $5,600 seems awfully cheap now.
The lawsuit says Sawyer originally purchased ablue Traverse on May 7, but took the SUV back the next day for a black one. The dealer's sales manager made the swap, allegedly without saying anything about a price differential between the two. Either way, Sawyer signed a final contract for around $34,000 when the vehicle he took home had an actual price of closer to $39,000. On June 15, Sawyer was taken into custody by police, but the Commonwealth dropped the charges after finding insufficient evidence to pursue the case.

Once again someone's been brainwashed by a lawyer to sue for an outrageous amount of cash. Yeah I think the gentlemen has every right to file a claim against the dealership. But a couple hours in a jail cell isn't worth 2 million.

This is true, If all this went down and I got tossed in they would have to do more then give me the agreed price though, not saying 2 mill. but a couple of bucks for my time and inconvenience. dealership is lucky something didnt happen while he was in there , like his wife dying in a car crash on the way to bail him out. that would have been a cluster fuck!

Now if my wife died on the way to bail me out the yeah I'd sue the shit out of them. But for a couple of hours in a holding cell I'd honestly tell a lawyer to kick rocks and talk man to man with the owner & work something out. Unless the owner was a prick LOL.
On a side note my friend is having issues with Morgan Hill Ford. He bought a used car and they told him they changed ALL the fluids. He checked everything before he left except the transmission fluid. It's a Nissan and you can't just pull the stick out ( H asked the salesmn how it came off and he didn't know either LOL) you need a screwdriver I guess. He checked it when he got home. It was really dirty to the mileage.
He called Morgan Hill to talk to the salesmen about bringing it in to have the tranny flushed, because they did tell him everything was changed prior to buying it. They told him to kick rocks cause it's a used car and they don't change the fluids on them before they sell them.

Yes, but you start high, and settle for around $100k + attorney fees. Not bad for a couple of hours in jail

thats a couple of hours of your freedom took, yes all of us just lay around and do nothing for a few hours, but still that's our choice we werent wrongfully accused of b.s. if it was me i would of gone for even more and waited on the dealerships offer

Nah my time is worth a lot of money to me. i would have gone for a lot more cause that's how much my time is worth to me.
