This is not aimed at anyone, just small things I learned and change about myself to get ahead.
Do police really use profiling?
As a young Mexican growing up in East San Jose, when I was 17~20 I got pulled over probably 15 times. I got a ticket 3 of those times. Was it profiling? At the time I certainly would have said yes but, it definitely wasn’t. It was police doing an awesome job. If you fit the profile you will be a suspect. You don’t want to be profiled don’t dress, walk, talk, or drive a car that begs to be pulled over.
In CA a gang member is someone who shares a color or a symbol, so if you are wearing clothes that look like something a gang member might wear don’t yell discrimination or it’s because I’m Mexican, black, Asian, ect…. It is likely your hat, belt, bandana, shoes, or one color outfit.
You walk with a gangster lean or like you’re the biggest person on earth, you are now a suspect because many peace officers know that’s the gangster walk.
You talk to a peace officer like you are speaking to one of your “homies” bro…. You will certainly be profiled. I use slang words too, but there is a time and place for everything and in front of a peace officer, judge, or a job interview are not the right time.
You drive a nice 5.0? Well, be aware that tinted windows in the driver/passenger side are an excuse for any officer to pull you over regardless of how virtuous and innocent you are. Driving erratically and using off road x-pipes are going make you subject to being pulled over too. What about broken lights and missing front plates. If you get pulled over it is not racial profiling it’s your car or the way you look.

profiling is profiling regardless if its based on your skin color, dress or car u drive.
One of the things I learned in my CJ classes is that probable cause and reasonable suspicion to stop, detain, question or arrest someone is not based on physical discriptors alone. A good officer who doesn't want to be in court constantly getting sued will conduct his/her police work in a manner that shows there was more for a stop than "baggy clothes" or "he was driving a 5.0". I hope every officer holds themselves to a higher standard than the "profiling" you described. I know I will ![[patriot]](graemlins/patriot.gif)

I am not a peace officer, but work in a good place for now (Cisco Systems). I do plan on going back to school for my teaching credentials or an MS in Justice Studies...Scary

I never said change who you are, just who you are depending on the setting. When I would go take notes in court for certain courses the people that you see in line to get in are often times dressed down. I would see people in sweats or in tall tees waiting in line then appear in front of a Judge for a criminal judgement (not a good idea). I listen to my Chalino Sanchez and use street talk, but like I said time and place for everything. Some people just expect society to adapt to how they are, when you are part of a society not the other way around. So, If I adjust my behavior and manorisms depending on the enviornment then I am a happy dumbass, ignorant, sell out.....

Just remember.... Every trafic stop, could be his last. Cops know this by they still pull you over for illegaly tinted windows, loud music, long tubes with no cats and one chambers .....
Just remember all the shit they deal with on a day to day basis. Not saying that some cops ( a small portion ) do some dirty stuff. The majority of them are good guys... I can tell you that the cops that were shot in Oakland doing a trafic stop... Led to the death of good cops... If you don't believe me look up each one of there bio's and some of you might feel differently

I am definitely sorry to hear that. The first thing I learned from my studies is that you can be searched at any time even against your will. I was taught that the mere fact that if you are asked to be searched and if you refuse, the refusal alone is the reason. It effectively becomes a double edge sword. I know this is 100% wrong, but the assistant dean of admissions where I went to Law School taught this to the class. Sorry, folks but the truth sucks.
If you think this is harsh, it gets worst and more serrated as you learn more and more. It makes you understand why lawyers and politicians (96% of politicians are ex-lawyers, including Obama) are so spineless and ruthless.
The first day of law school I was told to forget about right and wrong and leave all my values and morals out the door. I didn't finish my law degree for personal reasons, but I learned enough to know it is something that I don't have the time, money, or stomach to endure.

I was taught that the mere fact that if you are asked to be searched and if you refuse, the refusal alone is the reason. It effectively becomes a double edge sword. I know this is 100% wrong, but the assistant dean of admissions where I went to Law School taught this to the class. Sorry, folks but the truth sucks.
If you think this is harsh, it gets worst and more serrated as you learn more and more. It makes you understand why lawyers and politicians (96% of politicians are ex-lawyers, including Obama) are so spineless and ruthless.
The first day of law school I was told to forget about right and wrong and leave all my values and morals out the door. I didn't finish my law degree for personal reasons, but I learned enough to know it is something that I don't have the time, money, or stomach to endure.

The officer could have searched you if he wanted to. I actually taught this very subject to juveniles, while doing an internship with the Fly Program for Santa Clara Law School. If the cop knew or wanted to he needs absolutely no reason, but your refusal alone is the probable cause. I am not trying to prove you wrong, just what I learned from lawyers and law professors. Like I said it is wrong, wrong, wrong, wrong, but the law is not about right or wrong it is about the law and just becuase you don't know the law doesn't mean it doesn't apply to you.

I just had a chance to digest all that you wrote. It seems my message has been mis-interpreted. I simply gave feedback on my personal experience with profiling. My message comes from being on the receiving end and later learning as much as possible to decipher why I was so angry. At the end it was me who didn't understand.
Your comments I have heard before, almost word per word while attempting to help juveniles on probation.

You have every right to express yourself. I am not saying it is wrong, but Ca law states that being involved in a gang is illegal and it is defined as a group sharing a symbol or a color. This leaves the door open to many many possible things. Which is why I gave examples of the most likely to get you harrassed.
You were just minding your own business sounds like just hanging around doing nothing wrong.
Believe it or not. Loitering is actually illegal in CA. If you pay attention some shopping centers actually post signs No Loitering. That just reminds you it is agains the law to hang around doing nothing. So, a cop bugs you for breaking a law (infraction), you act up not knowing the law and get harrased (searched.
You are mad as hell because you weren't doing anything. Just hanging out minding your own business.
The cop is mad becuase you gave him attitude when he was just doing his job and searching someone who was loitering.
I could go on and on on every comment you wrote, but I will be here till 6AM in order to explain everything in detail.
Just note that the cops usually are clueless when it comes to the legal nitty gritty details and with you having pre-conceived notions about what the law is there is a constant problem with police encounters ending negatively. This only helps stimulate the us vs. them attitude on both sides.

I have been a Police Officer for about 14 years now. Hardest freakin job in the world IMHO. You are damned if you do and damned if you don't. Flip side to everything you do in the job. It's not just about writing tickets. So much more. You have to be a social worker, doctor, mental health prof., lawyer, child care giver, parent, the list goes on. People don't like me just because I wear blue. Seriously, does anyone ever have any positive contacts with police. Usually not. If it's not for getting a citation, it's because someone broke the law or is doing something wrong. This usually leads to someone going to jail. No one wants to go to jail. We are not miracle workers but are expected to be. victims want results. Suspects want not to get caught.
I like helping people, I like catching the bad guy, and even preventing crime by just remaining visible. I like to think I am fair and treat everyone the same. I can be an ass though if it helps get through to someone.
I don't know how many times I have been told by a suspect that the only reason I stopped them was because of their race. Never because I saw them speeding, smoking dope, drinking in public, driving while intoxicated, blah blah blah. It has gotten tired. Whatever, I'm still professional.
My cop buddies and I don't sit around and plot how many blacks, hispanics, asians, indians, somoans we are going to stop and jam up.
Comming up as a kid, I had been spanked by the police. Several times for dumb kid stuff. Couple time for not doing anything wrong other than being at the wrong place at the wrong time. I have had my share of tickets, all but one deserved. The one I probably didn't deserve was after I got lippy. Talked myself right into that one.
I was arrested and booked for drinking in public when I was 20. I never did dope, robbed anyone, hurt anyone, did any felony, hustled anyone.
I certainly can't place my feet in anyone elses shoes who has had different experiences. With that said, I see the hate in peoples eyes when I am in uniform. However, I deal with it and it is left at work. My only goal is to go home safe every nite. Very hard to do in this line of work. Seems a lot of asshats out there want to hurt me.
I don't recommend this line of work for anyone. If I could do it all over, I would be a Chiropractor. Mine has a lot of nice cars.

I read the statistics on San Jose East Side's area pull over data while doing my undergrad. Over 70% are minorities or African Americans. Have you ever been to the East side?
I grew up on Pocoway (grammer school) and Gramercy and all the way till my senior year at James Lick High School I still lived there. I could count the number of white people I saw driving around. So, does it surprise me that such a disparity of justice exists: No. I was actually surprised when I learned 30% of the stops were of white people. Where the hell did they come from. Comming up as a kid, I had been spanked by the police. Several times for dumb kid stuff. Couple time for not doing anything wrong other than being at the wrong place at the wrong time. I have had my share of tickets, all but one deserved. The one I probably didn't deserve was after I got lippy. Talked myself right into that one.
I was arrested and booked for drinking in public when I was 20. I never did dope, robbed anyone, hurt anyone, did any felony, hustled anyone.
I certainly can't place my feet in anyone elses shoes who has had different experiences. With that said, I see the hate in peoples eyes when I am in uniform. However, I deal with it and it is left at work. My only goal is to go home safe every nite. Very hard to do in this line of work. Seems a lot of asshats out there want to hurt me.
I don't recommend this line of work for anyone. If I could do it all over, I would be a Chiropractor. Mine has a lot of nice cars.

you must have grown up in an easer time, cops are so much beter than civilians now a days!
when i get home from my regular job where i make my regular pay to pay your extreem salary so you can extend your gold hand with a ticket that snatches the rest of my pay check for something as petty as a front license plate violation, ill post more towards you because id love to hear your side of the story. ![[Eek!]](eek.gif)

Emergency services are exempt for the cell phone law while in performance of their duties. Says so in the section. 23123 v.c. I would agree though, I have a hard time writing anyone a ticket to anyone for that if I'm doing the same thing. But at the same time it is no different than using the police radio. A lot of multitasking goes into driving these patrol cars. Phone is a necessary evil. I use it as little as possible when working

Cops do racial profile like a motha fuc** do you know how many times ive had people i know call the cops when they need help and when im there trying to help my family or friends they come to me first guns drawn and put me in cuffs if i was the criminal why would i just be waiting for you to arrive officer. Cops pulled me over just for having the top down in my mustang before. Officer may i ask why u pulled me over? Yeah because u have dual exhaust. Would you like to check under my car for smog equipment? No i just want to check your license and registration. He followed me back into my apartment complex and i had commited no crime. And they wonder why people in the community dont respect em recently got pulled over and my boy asked opd how u like the job . cop says its a job thats it. I told him get on your job catch these murder suspects instead of pulling me over for nothing gave me my paper work back with no ticket.

I changed my outlook on life years ago any one who speaks to me in person can get that right off the bat but because of my appearance i get judged aka racial profiling. Cops have told me straight up your latin and have a mustang so we took the time to pull you over and add to the statistics. Ive told them in response whatever happened to human rights they tell me you have just lost them thats when i learned to shut my mouth and say yes officer instead of arguing its different i pay taxes and work my ass off daily but i am still just a quota for the police.

It is a really unfortunate situation that you keep getting singled out.
You know the phrase "don't judge a book by it's cover". It is a novel concept, but not always true. I give everyone the benefit of a doubt, but don't expect everyone else to do the same.
While training for several sales jobs and sales seminars I keept hearing the same concept which is: Most people judge someone based on appearance alone in the first 3 seconds. Then if you speak, your first couple words complete the analysis of who we are or appear to be. I personally assume police officer or potential employers will asses me this way, but I also know that certain people will never approve or respect who I am regardless of how I look or talk.

I would not start shit but I would certainly watch my back because they are most likley packing a weapon. Possibly have alchohal and drugs most likly a warrant. this was a study done by uc berekly and they came up with the accurate stats with police reports on different races and than coming up with that total. also it is a point to get across, the point is that blacks and latinos always complain about cops coming down on them when they commit the most crimes, its not because of there race but because of what the majority of their races do to commit these crimes and the rest of the innocent blacks and latinos have to suffer for it also which is wrong, punish the guilty ones that do these crimes, not the innocent. all races commit crimes but other races do it more than others which causes all of this, and its not as bad as these races make it out to be.

Ive had my fair share of F the police moments, but in all honesty i brought each instance on myself.
+Though ive been able to lie my way out of tickets, and lie to get tickets dismissed.... its just that; a lie. I was in the wrong each time.
I will say this though.... i was rolling through Castro Valley the other day aka CHP central with my recently put back together GT, with an o/r X and 2 chambers with dumps and tags 2 years out of date. Looked behind me to see a chp on my ass, and pretty much expected to be pulled over due to tags. THough my excuse was valid in just getting it running and trying to reg it, i was surprised to have not been pulled over.

Statistical data has to be from a valid and un-bias source. In my studies, I was only allowed to look at scholarly journals and the Uniform Crime Reports the FBI releases every year. The FBI report is the one you hear on the news where Detroit, Richmond, and Oakland are usually listed as the Murder cities of the U.S. per capita. If I recall for scholarly journal reports it was about $400 dollar a year membership with my then student discount, but some professors have personal copies as did the Dr. Martin Luther King Jr. Library (you have to be a SJSU student to view or rent).
After looking at these sources for years I can tell you that although minorities and people of color commit the most crimes statistically; the real issue is why and how can this trend change? If minorities or people of color had less negative encounters with police officers this would certainly be a good first step. I can’t change the way a police department operates, but my initial post was just to give an idea on what can potentially have an effect on police pullover data. It is without question that we have a right to express ourselves in almost any way we want. You can dress, walk, speak, and carry yourself as you wish and no one has any business taking those privileges from us. We do however have to know that expressing ourselves to our hearts content comes with stereotypes and people may develop inaccurate pre-conceived notions about who we are. That decision to express yourself only each and every one of us can make and decide upon for ourselves just take responsibility for what happens when you do so and don't complain and blame the man for all things gone wrong in our lives.
I think profiling exists and I can become a statistic or fight it anyway I can. If being pulled over is worth "keeping it real" then you have made that decision and the benefits out weight the costs for you. Which in my 88 Coupe with no front plates and off road x-pipe is a decision I have made and will accept all that comes from that decision.

In almost all cases the victim knows the child molestor. Whether it be a family member or someone they meet or encounter frequently. In some rare and unsuall instances it is a complete stranger.
Child molestors can't easilly be profiled because of the reasons I mentioned. It could be anyone and unfortunately they are a protected class behind bars to add insult to injury.

Damn just as I try to give the boys in blue a chance they tow my boys cobra. same racist cop that pulled me over for having my top down in my stang pulls him over for having a cobra. So ok my boy is dumb for not renewing his license but i just want to talk to the cop and ask him what the status is of them finding who broke into three of our cars and why havent u caught them instead of fucking with us when we have a wedding to go to. This whole time im in a suit with gators and guess what the cops says get againts the wall. officer i am just trying to speak to you or your partner.sorry but i live in belmont cops just cant think that i work my ass off to pay their salary there were two cops and one couldn't give me a second of their time. this is not deep east oakland at 2 in the morning this is a main street in belmont at 2 in the afternoon wtf im not gonna pull a pistol out and pop a pig in plain daylight. O and of course he calls backup ok let me talk to u then officer. no just wait againts the wall he says just tell me why all three cops where white. im not certain but maybe a woman officer or a minority would have given me a chance to express my freedom of speech. damn didnt see that coming but this is why cops will never be ok in my eyes tryed to look at them as people but they treat me as a criminal for that i will never forgive them.

Every race has their statistical hang-ups. It should not influence how they are treated tho. For instance ask yourself which race tends to be serial killers. Which race tends to do Columbine type heinous crimes? It would be a very sad existence if everyone is defined by their statistical propensity to commit a certain act. People are not pulled over because they look like a chil molestor (average middle age white guy), they are pulled over for some of the reasons I mentioned. The first thing that comes to anyones mind when they see a middle age white guy driving around is likely not "child molestor"
Profiling is an idea that we uncontiously develope of how or who someone is. This is why you never hear police departments trainning for this activity, it comes on like auto pilot and when statistics show they do it; they just deny it. I can see your argument, but child molestors usually look like a normal white middle age guy. I doubt police will pull someone over for looking normal, but they will pull someone over for looking thugish with no front plates and an off road x-pipe and as some of you posted even when you look your best and do everything by the book you still get profiled.
No matter how well dressed or well spoken you may be the fact is you may still look like a minority or person of color. I certainly would never drive my Coupe unless I had at least a current liscense and registration. I don't go downtown unless I have a stock H-pipe and front plates eighter. Time and place for everything and it sucks, but as a fellow Stang enthusiansts we have to take extra steps just to ride our cars. Porsche 911 owners are not subject to what we go through, they do however have to put up with slow cars

There is another flaw in your logic as normal is subjective. Take the thug, place him in 9th ward New Orleans you have normal. Take the white guy place him in 9th ward New Orleans you have abnormal. So does the white guy get profiled at this time? Afraid not more often than not. Because that would go against the overall grain of society. But take this white guy and place him in suburban America and he is now the normal. Place the thug there he is abnormal. Gets profiled quick fast and in a hurry. It is deeper than what can be discussed here, as most of it is psychological. Which is why I would propose a modified Briggs Myers test for cops, that would measure their background, geographic origin, socio-economic status of parents, and sensitivity level (I have reasons why I chose these sections too). From that test amend whatever required training is needed as a baseline to be a cop. Right now the one size fits all training I do not think is an appropriate approach.

I haven't seen you a single flaw in my logic. You take a thug in New Orleans and guess what? He is still a thug. Put that thug in East San Jose and he is still a thug, put him in the most elite golf club course = he is still a thug.
I was afraid to use the word normal as this is a No No in legal terms and the most difficult term to define which is why I gave in parenthesis what I meant by normal. In legal term there is no normal person.

actually there still is. Because those "normal" often resonate differently through the legal system. And the court of public opinion. But without getting too into it as I promised. It is linked to why a African American on average gets more time for the same crime as a White American. Because of those very same perceived normals. Believe me it is bigger than Political Science 101. Its inherited, learned and tracked behavioral science down to the individual level. Which is why I propose a modified Myers Brigg test for any public servant.

Ever notice when there is a serial killer on the lose there have racial profilers on the case and what do you know, there usually right. If whites are more prone to molest children then they should be profiled. Why argue it, get them off the street before they hurt more children. You don't think we profile Iraqis in the war over there, of course we do; be crazy not to. Some of my friends lived in rich areas when I was younger, and I got followed by the cops many times visiting. I'm white and I'm young so I'm prone to getting into trouble, which I did many times. We'd smoke some or maybe drink at a party and they would follow us for miles waiting for us to make a mistake to stop us. You know what, they were right because I was doing shit I wasn't supposed to. How do stereotypes come about? Do we just make them up? Why do so many of us laugh at stereotypes, maybe because there is a lot of truth to them. Is it possible? Let's be realistic and not so fuckin' sensitive about this. Another point is if we just obey the law we'll never have anything to worry about. Go ahead and pull me over; if I have done nothing wrong I could care less. Just waste the cops time and have fun with it...make him search your car for an hour with backup just to find nothing. But we want excitement in our lives which is why we break the law. If you do it you have to be prepared for the possible outcome.
