Ok so heres the deal, my girl really liked this one black 2004 Bmw she seen at AMINS Dealership in Sacramento.. She went there.. The salesperson talked to her nice, she didnt really give a damm about his sales skill because she liked the car.

Ok so she noticed the car had three little scratches in the back bumper, missing sunroof cover and the traction button (DSC) button wasnt working along with the check engine line.. Little things... The salesperson told her that they didnt have time to fix the car sameday so they told her to come back next week to get the other things taken care of. So she purchased the BMW and in the contract they stated that they will fix those problems.

Ok so she went there last Friday to get it fixed and they made her wait 5 hours and yet bullshitted with her and decided to give her a rental.. So after five hours of waiting they told her that the car will need to be left overnight to be fixed. They told her that they will fix all the things wrong with the car. So they gave her a rental..

Three fays passed, they called her and told her that the car is done.. She goes and notices nothing has been done and told her that they fixed the check engine light.. She asked what about the scratches, traction button and sunroof cover. They told her "thats the only thing we can fix. The owner of the dealership will not fix the rest of the stuff"

I called irritated today and spoke to the sales person and he told me that thats the best they can do and thats all they are going to fix. They said that its nothing in the contract and that states that they're going to fix anything.

I personally believe that they were just bullshittin with the girl and took advantage of her by sweet talking her.

In the contract it clearly states that they were going to fix everything wrong with the car including the scratches and missing sunroof but they havent done anything but get rid of the check engine light.


I know some guys are on Cafords are into the whole sales thing @ The dealership.. So im asking your advices, im heading down to Sacramento tomorrow to talk to the ripoff sales people face-to-face.

What do you guys suggest that should be done?

If it states in writing that they will fix certain things they have to do it, otherwise you can take them to small claims over it, or have the contract voided, for breech of contract.

I know, i been told the homie to just stick to your word and just get the shit done, dont pull no shady shit on no female. He replied "yeah bro personally i will fix it" he told me that 3 days ago. But then today he said "No man, my manager will not fix anything".. I told him "You told me that youre going to fix all those things, so now your telling me your not, ill come talk to you tomorrow" He replied "sure".

Yeah its in definite writing. The thing is, they like to waste her time, everytime she goes there, they pull fake things off and tell her different things. LIke the DSC traction thing, they told her that its for a CD player and its not going to work.. They keep bullshittin with her.

im not sure.....i would suggest legal help if youre that concerned about it. Is the car still under warranty? If it is take it and have it fixed at another dealership, then take the one you bought it from to small claims if you have to come out of pocket

Yeah im concerned now since the sales guy told me that was going to fix everything then denies everything. They gave her 2 year warranty which i doubt is legit. I will double check tomorrow.

what does it say on the Bill of sale.
Precisely, what does it say? does it specifically identify each item that's malfunctioning and/or defective that you want fix?
please post that so people can advise you correctly as to what possible outs you might have.

Dealerships are always like that.
My buddy bought a bmw also, it was missing the little knob to move the seat forward. well.. they put it on witting that they would replace it. and they did( a couple of days later). well.. the seat wouldn't work. and after some arguing, technically they were right, they replaced the switch but there was nothing stipulating the condition of the actual module.
Bs.. but that's how it works. =(

Used cars are sold as is.. with no implied warranty unless, ofcrouse, it's stated. if there are scratches of whatever and you were smart enough to get them to promise to fix those in writting then my hats off to you.
Just be careful, don't expect them to paint your whole bumper if anything they'll just touch it up with some cheap as paint... same with the dsc botton, warranties don't cover missing bottoms, unless.. once again. it's specifically stated in wrtting.

I dont have the writings infront of me but before she bought the car, she gave me a call and i told her make sure you make them sign a paper stating they are going to fix everything you told them.. She made a list of things that needed to be fixed and they agreed and signed the paper. But they are denying it now since the main owner "AMIN" is out of state for a few weeks. They keep claiming that "AMIN" is declining to fix anything on the car. SO im talking everything written to them to their face and im pretty sure we will have a result tomorrow either one from me or one by them [Smile]

Worse comes to worse, if they decline, they only have about 30 cars in the lot, now if they are being that cheap to fix little scratches on her car, they're going to be fixing scratches on the rest of those 30 cars LOL

well, i ve learned working at a dealership is "the squeaky wheel gets the grease!" take it to the next higher person in charge or return the car if possible! see if they have a customer serive rep or take it too corp office if they're a bmw dealership.

As far as I remember everytime I have bought a car there is like a half sheet of paper that is a carbon copy. They usually write on it nothing implied and nothing promised and make you sign that. It has a bunch of lines on it and always is in he envelope with the contract. If they slipped that by her and she signed it she is SOL. If they wrote all the issues and she has a copy I think there is some info on there for legal recourse.

She contacted the dealership earlier around 8pm and a guy named "JIM" (sales manager) told her "dont bring your car in here anymore because we are not going to touch it and stop wasting her and their time".

I think im just going to pay them a personal visit.

Its not a BMW dealership, its just another small dealership out in Sacramento with a bunch of german cars and luxury cars.

Oh another question, she purchased warranty with the vehicle, she paid $3000 extra for it. Is this a BMW dealer warranty or does she have to take it to the same dealership over and over if anything breaks down?

You can just look at the papers and know for sure. i really doubt it's a bmw warranty though.
I seems your girl just went to one of those small dealerships that sell use/crappy/former leased cars that are abundant everywhere.

I'm pretty sure the insurance it's for a third party. meaning. if something happens, she pays a deductible and the shop(any shop that will actually take that particular insurance) contacts the insurance for the balance. Good luck with that.

once again, look at your Due Bill.. they cannot tell you to F* off if you have stuff in writting. i'm sure you could somehow void the whole sale.. but once again, it depeneds on what's written. not what is assumed or was "said" before/during/after the transaction.
If you have legal grounds then look for legal representation.

If its a BMW purchased from a BMW dealer, it has the certified BMW warranty if you paid for extra warranty. Everything is covered under warranty, you can take it to any BMW dealership and get it serviced. And if your mileage is under 40k, it should still have maintenance coverage as well. Meaning, oil changes are free, and brakes are free.

I agree with the others.. if its on the contract they HAVE to fix it. You can talk to cleveland since he does this type of business and would not be a bad person to pm if anyone is looking for a car. Anyways, pm him to see if there is any law or code that you can bring to the table.. good luck

Thanks alot for that report, im in class right now and will print that out and take it directly to them and demand to see the owner of the dealership.

The thing is, i wasnt aware of who she was doing buisness with, after she has purchased it, she told me about them after.

Looks like there is going to be lots of complaint from me today along with her and along with 2 other witnesses.

Ok so got back from the dealership without any conclusion or agreement but a verbal altercation with the sales manager and 2 of the sales guys..

I walked in with the paperwork and asked to speak to the highest level manager on duty. One guy came up to me told me follow him to his office.. He knew what this was for by looking at the BMW we brought in. I explained to him whats going on and he jumped to a quick conclusion by saying "Look, i gave this girl a really good deal and we have spent alot of money on this car already"..I told him that i will report this to the BBB and also mentioned contacting the owner of the dealership. He told me i can do whatever i want, they have over 30 lawyers that handle these cases on a daily basis and such. I asked once again to resolve this issue as professionally as possible and yet the sales manager kinda raised his voice which ticked me off.. I told him that all those fucken cars from hurricane Katrina and they are all pieces of shit. I told him that all HIS sales people are fulla shit and lie to customers for a living..


So as i was walking out, there were a bunch of sales guys just standing by the car chit chatting and laughing.

So i left and as we were leaving my girl flipped off the indian sales guy who sold her the car & lied to her about the whole contract thing. He had the nerves to flipp her back off and say "fuck you too bitch", i got out of the car and told the indian dude "what did you say Ghandi?" he kinda backed off and played it off like he didnt say anything so as i was approaching the whole sales crowd infront of the shop, the manager yelled out "just leave and dont come back".. I then told all them that i am leaving since i am with a female but i will be back and definetly will be back for that dark Lord Ganesh Monkey that works there in the tie soon after work.


Ahhh what a day. Im back home now and nothing was resolved. I havent heard from the owner of the shop either. One of my cousins do have his personal cell phone number that he will provide. Im thinking of just submitted everything to the BBB, Sacbee.com, DMV Used Car Sales Investigative Services.

Oh BTW there were more words exchanged but i didnt threaten them in any way, well maybe to Chinpanzee looking indian guy that was there with a funny hair-do, i wish i catch his ass afterwork one day for talking to a female like that.

What do you guys suggest now? COntact the owner? I have a feeling that the owner does not know whats going on behind the scenes of this whole situation.

I didnt buy it, a girl bought it [Wink] Half of the cars at small lots are known to have problems and i spoke to some dealership personells and they told me that most of the cars at used sales lots are from auctions or from New Orleans after flood damage.. They are making profit over here

And the warranty she has is a 24 month Western General Warranty programm.. Not certified BMW

says that verbatim/? if so you are sol.. but if it's specific as to what is concidered "bring wrong with the car" you might have some legal ground to complain.

Thanks, yeah we have already reported it to the BBB and DMV used car sales investigators.

I havent looked closely at the contract but there is a "CONTRACT CANCELLATION" form with one of those forms also.

The car is great its just since they told "HER" that they will take care of the little scratch and fix the traction control button ; she wants to have it done through them.

The car is perfect but most females would get bothered by a scratch on a bumper lol so that scratch is bothering her more then the car's traction button haahaha

Exactly, the place where they were standing at was the main enterence and where the cameras are at [Wink] Its cool though, the guy gets off everyday at 9pm and drives a 1996 Lexus Es300 and lives a few blocks away from the dealership .. thats all [dance] But u know what they say "Get them when they least expect it and get them good"


And trust me, the Ghandi who called my girl a bitch is going to get what he deserves [Smile]

After physical confrontation with Mr Manager Jim, they are now agreeing to fixing everything. Will not go into details what went down but that fucker was shaking like he was pushed into the Antartic accidently.

I made him sign a paper on 9/24/2006 stating that he will take care of everything..

just make sure you take a FUCKLOAD of pics and have it mechanically checked out by a separate shop and have something in writing from them, before you go in there, and i would think that you would be covered.
