To sell a used car am I required to smog it first? Im selling my 89 and i took the stock h pipe off. I was just going to include it in the sale.

This topic has been debated many times. I think technically you are required to smog it as the seller (per ca law) but if you disclose that you are selling "as is" "buyer smog" and the buyer fully understands the terms, you will be fine. I have never smogged a vehicle that I have sold and never had any issues. Just make sure you write that on the bill of sale and get the buyers signature. BUT...Smogging the car will greatly help your selling point. It is piece of mind for both you and the buyer.

seller has to have a current smog inspection period. There is no loop hole to be had on it.

By current, do you mean his tags are up to date and the car is legal to drive on the street? Or current as in he needs to have a recent smog cert in his hand for the purpose of selling?

by law in CA you have to smog your car before selling it. By current mean recently smogged. I think smog cert are good for 30 or 60 days. Also the cert is only good for one sell.
We all have sold cars without smog cert, but if the buyer changes his mind, your "AS IS", doesn't mean anything.

look just sell it as is bottom line, if the buyer changes his mind and makes threats this will work in your favor cuz i know we all write a way lower bill of sale when selling so if the person wants to fuck around proudly give him his $500 back that was written on the bill of sale and get ur car back

put the car on non-op before you sell it.
I bought my 89 gt on non-op as a non running car and was able to get the title in my name and the reg transferred - still on non-op - into my name for a $15 fee at the DMV.

+1 even if you put "buyer smog" in the bill of sale and both parties sign and agree. The buyer could still come back and get you. I think the only around it is if the car is non-opped and sold as is.

The buyer can take you to court an make pay for all needed smog repairs.
An a smog is good for 90 days.

This is my take on this. If you want good money and sell fast just smog before sale. It saves you a lot of troubles. The only time i kinda dont like to do the smog thing is when i sell a car super cheap. In which i tell people if u want me to smog then agree to buy the car full price. But by CA laws u have to smog before sale
