So I found some new tires on ebay but they have 2010 production dates. Even tho there new are they too old?

Tires are usually good for 7 years at least

Not true. I have seen numerous tires separate at as early as 4 years old. Most tire manufacturers recommend replacement at 6 years, and any shop worth it's salt will say NO to anything over 10. Stop skimping out on what keeps your car planted on the road people. That includes Grey market Chinese tires, runway durun, sunny, wanli etc. If it sounds too good to be true, it probably is.
