Do you think its worth my time to go to court and fight this ticket?
If I plead not guilty & the cop doesnt show am I dismissed?

Or should I just pay the fine ($489.00) [Frown] stupid I know first and last time I do this. Took place at 6:23 am

Need your help ca-family

Yes. i remember i got ticket on carpool. but I went court and the cop didn't show up then I'm not guilty and I didn't pay the ticket. Whew.

Go to court and wait to see if the cop shows. If he doesn't then you might be off the hook. But if he does, plead guilty and ask if you can have a fine reduction. Tell them you weren't intentionally in the carpool and it was just force of habit since you carpool with your partner every day.

do this, but if he shows ask to reschedule the court date, and see if he shows up next time and do it again if he does. sounds stupid but it works

Alot of the traffic ticket "kick" attorneys, use the fact that, you can use the carpool lane to pass another vehicle if you feel the vehicle your passing is impeding the flow of traffic.

Look on your ticket and see what he marked down as traffic conditions? If he has it listed as heavy traffic, your in luck. Fight it and see how the cop redefines the experience, if he says yes there was alot of traffic and it is possible you used the lane to pass a vehicle you will be in luck.

It isn't a moving violation. Couldnt hurt to fight it as its no loss for you either way but time. . As far as the fine being reduced you'll hear in your arraignment that its a mandatory fine and can't be reduced. Unfortunately I've had to many tickets over the years I can almost recite the arraignment speech!

Recently got a speeding ticket. Decided to fight it. Fighting tickets these days isn't how it has been in recent years, whether the cop shows up or not, the district attorney(or assistant) is now sitting in on most traffic trials. So even if the cop doesnt show up(usually dropped in the past) they (DA)will ask for a continuance until a time that the cop can be present. Ive now showed up twice to trial and the cop didnt. I asked the judge for a dismissal and was denied and have to show up for a 3rd appearance.

So IMO since it isnt a moving violation and doesnt affect your insurance, just ask for monthly payments.
