Well its really my Mom and Sister that need advice. 4 months ago they both went to a toyota dealership and bought black 2011 prius's. Yes I know..Pretty lame car choice but nun the less, they walked out on the same day each with a black toyota prius. Both had very similar options and after purchase my sister had a few dealer installed goodies such as leather, bluetooth, and xm radio. My sisters commute is way further than my moms and as of today she has over 4000 miles more than my mom does on hers. This morning my mom gets a call from the dealership saying that they mixed up the cars and paperwork. That in fact my mom has been driving my sisters and visa versa. The dealer recommended that they just switch keys and that my sister bring in my moms old car to get leather put it and my mom can just take my sisters car. My mom told me she doesnt even like the leather, and my sisters car has 4k more miles on it than hers. I am wondering what my sister and my mom can legally do here? They were both sold cars that did not match there paperwork. Can they return both cars and get new ones? Should they just switch keys and make it easy on the dealer and there screw up? This is the weirdest situation ever. Oh, and to offset the uncoolness of there prius purchases I went out and bought a Raptor that same week to make me feel better about the fam...Any help you guys could give would be appreciated...

If it were me I would make the dealer give your mom a new car kuz that's just wack to end up having 4k more miles for something that isn't her fault at all.

Why won't it fly legally? I mean they were both DIFFERENT costumers that happen to be mother/daughter. What if it was your mom and some random person why does your mom have to get their car with 4k more miles? Its NOT her fault, they should be responsible and take the "loss" for not being careful on their sales.

Consult a lawyer.And actually,what does it matter that they got each others car,whats the difference besides numbers and paperwork?They each got the options they wanted.The only thing truly wrong seems to be the paperwork,why cant they just redo the contracts?

Make them deal with their mess, you shouldnt have to undergo any troubles. But i would definately NOT switch keys, get something out of it like idk a pass on a payment or something.

ok this could have become a sticky situation. i would ask for new cars for several reasons.
- if something bad happend, car was stolen and used in a crime and your sister reported "her" car your mom would have been pulled out at gun point. or vise versa
- if one of the cars went up for repo and im assuming your sister doesnt live with mom anymore. they would go to the given house looking for the car it wouldnt be there .they would skip trace the family and find the car at another house, then making it very hard to get the car back if not impossible because " the cars was not at the registered address and they were not informed thet the r/o moved". trust me banks are a bitch.
- if they got pulled over and the plates are on the wrong car. boom car goes to impound and more big problems

im sure we can come up with a infinite list of bad this that could have happend. i would just go to the dealership and explain to them how bad things could have been at the expense of their fuck up. i would ask for new cars or HUGE amount of the loan to be paid by them for the inconvience they caused.

Yeah I do but am I proud of it? NO. do I want to continue to own it? NO. Why do I own it? Kuz I bought it for $500 N it saves gas, no other reason.

Yeah,true.But that would be theyre problem,not the buyers.Thats exactly what id tell em too.

consult a laywer, let the dealer take a loss not your mom by getting a car with 4K more and not only that if your sister commutes im sure theres rock chips tire wear, car wear, and sister/ mom have different way to drive/ (abuse a car)...

bottom line dealer should be at fault and fix it, dont let them sweet talk them into switching keys

best of luck for both of them

right now we're going at a dealer for a car consuming oil as well...sucks

Yeah,true.But that would be there problem,not the buyers.Thats exactly what id tell em too.
i 100% agree i hope for their sake they both got loans thru toyota finance. the dealership is going to have to pay those cars off then set up new loans.

what i think they should do is... hopefully the sale department manager is a stand up guy and a "make the customer happy no matter what" kinda guy and will just take the two cars as trade-ins and hook them up with two new rides at a hook up price

RWC thats what we are shooting for right now. She called a lawyer this morning and he even told her this was weird territory. I convinced my mom not to bring either car to the dealership until she has figured out what she wants to do. In the very least she should end up with a new car imo

good! i think they should shoot for the trade-in on both cars and then they get 2 new ones at a hook up price with the loaded options. or you can call channel 5 on your side and get the lawyer involved. give them a chance to make it right tho on your terms.

The dealer is just trying to do what is easiest for them, that is a switch with added options for your mother. It would be extremely difficult, but not impossible to get the paperwork switched, but if faced with lawyers and unaccommodating customers screaming for new cars, they will probably do the tedious task of drawing up new paperwork. So, your mom and sister will end up having to go down to the dealer to sign the papers all over again. If I were your mother, I'd take the higher mileage car with leather seats and ask for an extended warranty along with free Toyota Care Maintenance. If she really really doesn't like leather, I'm sure they would be happy to switch the seats.

That sucks man!

I print up most all the F&I paperwork where I work, and it's not very hard to print new contracts. It could be all printed up in less than five minutes.

If you read their sales contract there is a clause (the very last one on the right column) Stating something to the effect "this contract can't be changed unless both parties agree."

Did you guys review the contracts at home after they called you?

lol um no.. have you looked at safty rateings & fuel milage. ford are at the top of both.. but it's ok if your a ford hater.. and i have a 04 toyota pick up. bought it brand new and it now has 70k problem free miles. and it pulls my trailer and mustang just fine.. I think they each need to handle it separately and there should be no reason why your mom shouldn't get a brand new car...Really, what if your mom goes to the dealer and demands her car?
