long story

But a friend of mine called me today to tell me that his cousin filed a police report on him


My friend borrowed his cousins SSN to get employment, they both agreed to use it even his cousins mom's was okay with it & family member knew about the situation, so far he only used it for employment, never took out a credit card, asked for a loan, asked for a cell phone line, buy a car or a house

they both did the taxes on their own one using his ETEN # (i guess thats what is called) & the other the regular method

So trouble starts when his cousin wanted to file the taxes after my friend had claimed them... (I guess he wanted the $)

so he threats my friend that his is going to call the cops and file a police report..... I guess after all he did make a police report and now is not sure what he can do


he has s few texts of his cousin asking for his W2 form, a few papers with his personal info written by him & his mom & family members as witnesses

he never broke a law until this, but all he wanted was to find a better job to provide his family a roof to sleep under and food at the table, never on trouble by the police, honest guy I known him for years


I told him that his cousin is doing wrong by accusing him of stealing his SSN, after an agreement was made by both parties and later turn around and report them stolen... basically his cousin is lying to the cops


what do you think he should do?

it is illegal to used anybodys ssn. it doesnt not matter if they was a written contract,, if they both agree that it was ok for the guy to use it then both of them are gonna be in trouble with the law..now its just up to who do the cops believe..

Why the hell does he need to use someone else's SSN? What is he a criminal? Tryin to avoid getting his wages garnished? or an illegal? Either way he is gonna be fucked. You can't use someone else's ssn. thats against the law whether they agreed to it or not. That's identity theft.

To top it off, your jack ass friend tried to file taxes on someones else's ssn? LOL! yep, he's goin to jail! The goverment is gonna know somethin is funny. Especially if they both worked this year. Basically your gonna have two different earning amounts for the same person. It's gonna trigger an automatic audit. So add on defrauding the goverment to his list of charges..

Even if the police report wasn't made the original owner would have to file for both incomes, putting him in a higher tax bracket.

The guy borrowing the SSN could/may have filed exempt on his W-4 and screwed the original owner.

Talk about getting screwed for thousands of dollars.

yeah your buddy needs to use his own ssn. now it will be his word vs his cousins. all his cousin has to do is play dumb and it will look like your buddy took it.

yeah I know is a lot to deal with for him

& hes is not a criminal just an illegal who was raised here in the US most of his life, and according to him he claimed the taxes so his cousin wouldn't get screwed for more $ on his earnings.

now I know if you file your taxes and arent happy with what you got you can make adjustments... wonder if he does that would it help him?
I know doesnt matter now but might help? but if so his cousing would get screwed for even more $

What I don't understand is why the guy who is using the SSN illegally even trying to file taxes? All W2 should of been sent to the official SSN owner? He used it to work & thats good enough why try & get extra? 2 diffrent files will get him in alot of trouble!! & calling the cops it will get worse!! Someone might get deported!! Just my $0.02

Once the person with the fake ssn is confronted by police it's off back to Mexico for him, hope he had a good savings account so he has a place to stay in TJ in a roach motel and to pay someone to cross back over . but to call an illegal an honest guy come on now he's an "illegal!" good bye to him and the person who let the other use the ssn# felony to him for tax fraud he fucked up trying to mess with the IRS , that's a big no no!

The IRS don't fuck around, look at Wesley Snipes, that fucker paid the back taxes and still went to jail. Your friend will end up serving time and then get deported after he gets out, it don't pay to play with the government.

The goverment KNOWS how much money you earned last year because the employer reports how much they paid you in payroll wages. if your friend is an illegal he should not be here anyway. he got greedy and tried to to get a tax return. Your cousin is now pissed because he did not relize that he was gonna be screwing himself when it's time to file taxes. He knows he is going to get audited ny the IRS so now he is claiming ignorance so he does not get in trouble. Filing two tax returns under the same ssn is an automatic red flag...

Filing two tax returns under a social when there's an agreement between the two is an abuse of the true citizen's privileges. I believe both the illegal alien and illegal citizen should be deported.

This is the kinda stuff that really gets me. This guy has lived here most of his life and never bothered to even try to become legal? People want to come here from all over the world to have a better life. People like your buddy mess it up for the other people who WANT to live here legally. [Frown]

You don't become legal over night,this process takes years,maybe the illegal guy has his application already submitted,but what they should have done,as some people I know that done this before,is to agree and that the person lending the SSN gets 1/2 or all the tax return,since there using the social for a higher paying job,it all works out anyways.

Your friend did something illegal, he will go to jail. There's nothing for him to do because he went down that path willingly, proving he had the cousins consent never made it right and won't keep him out
