I am renting a property and we found mold. We contacted the landlord and she said she would fix it right away but we had to move out asap because we didnt want to breath all that stuff. She agreed to refund our prorated rent, break the lease,pay some amount for the damaged property and give our deposit back, (nothing is in writing). My question is does she have to pay for the damaged items to be hauled and taken to the dump or am I responsible? also my room mate got sick and had to go several times to the hospital but the doctor didnt know what was wrong with her and she thinks it was the mold. What do you think we can do about this? oh and we had to look for a house within 24 hours to move out. Can I sue? or should I just get what I can without having to go to court? (Keep in mind she doesnt want to pay for the amount I seeked which wasnt that high) Any help/advice would be appreciated...... OH and I sent an email to the court adviser but they may take up to 2 weeks to respond ftl

Take a good look at your lease. I think what she is doing if fair and it's not like she was kicking you out of the appartment. The damaged goods from the mold could be considered negligence on your part. She also could just fix the mold and hold you to the lease so I wouldn't piss her off by threatning to sue. If she follows thru on what she said to you, I would just take that money, get a good tenant recommendation/verification of rent letter from her and move on.
