about a month ago i was going to a job interview at about 930am stoped at a 4 way intersection with stop signs, i make a complete stop and pull through the intersection and all of a sudden see some flashing lights down the road on my right, a motorcycle cop pulls out and pulls me over, of course he asks me if i know what i was pulled over for and i say im assuming for not making a complete stop? he says no try again.... and i tell him im not sure of any other reason and he says my radio was too loud which was bs, it was on and i was listening to music but it was no were near too loud. i got the ticket in the mail the other day for $240!!!!! so i decided to fight it so one of my days off soon i am going to go to walk in court and fight the ticket.

ive never fought a ticket and havent had to go to walk in court for anything so can anyone with some expierence give some advice?

oh and it was a non moving violation

Wasn't me.

Happened to me once. When I went to court I stated to the court it was the car beside me. I walked with the bailiff out to my car and showed that I had stock equipment. Ticket was thrown out.

I'm not sure how you can fight that ticket, but when you're in court I would ask the judge for a concise definition of "too loud". Is it up to the officer (as it sounds like was with your case), or is there a db/distance formula. Explain that your windows were down and with no traffic around you, the stereo volume may have been interpreted as louder than acceptable.

This may be the case. Now I remember my ticket had something to do with "amplified" music.

as to the distance it being over 25 feet what is the officer basing it off of? his line of sight? his idea of 25 feet? did he get off his bike and measure 25 feet? and i do belive you are wrong it is over 50 feet to get a ticket

a friend of mine suggested that i try from the angle that when i was in the army very recently the police were not as strict over the noise violations in colorado

i think that may be a good case that i was the only one in the intersection, it was in the morning and no other sound was around but my car and that may have lead the officer to believe my radio was louder than it actually was

LOL good luck, I pleaded NG to the same shit, no subs or nothing in my car, tried to fight it but judge didn't let me explain at all, FYI this was my 2nd time in the same week having a court date so that didn't really help, she recognized me from earlier..

Instead of getting up infront of a judge and making a fool of yourself, you will haave better chance trial by writted declaration.

Your best bet is to fight it by mail. There is a good chance the officer won't reply back, which will drop the ticket itself. If you go in court and try to explain that in front of the judge and with 100 other witnesses in court, you're getting no sympathy.

Go to the court clerk where the ticket is issued and tell them you would like to fight it by mail. They will give you a packet with a due date.

+1 this might work, but you gotta pay the full amount of the fine first to do so i believe, or give them a check or something, good thing about this is if you come back guilty, you could try it again in regular court....and cops dont get OT for the written trials, only the regular ones. [Wink]

hmmmm sounds like a good idea ill look into that some more, i just got the ticket in the mail and its not due till feb, ill have to check a few things. my friend with experience at this said that becuase its over 100$ the judge will offer a payment plan if i say that i cant pay the full amount at the trial which would be a lot better than losing $240 all of a sudden and i dont wanna lose the payment plan option

if i was blaring classical music im sure he would have more than likely givin me an escort rather than a ticket, stop bein mad u got burnt

I got a bullshit ticket like this a few years ago. Went to court and explained it wasnt me and that the ticket cop was very rude and didnt seem to be sensible. Dismissed.
