(11-25) 11:38 PST HAYWARD -- A Hayward man was shot and killed in front of his 13-year-old daughter while walking the family's dogs Tuesday evening, the result of a dispute with another man who took exception to one of the dogs sniffing at his leg, police said today.

Thomas Cunningham, 38, was shot outside a liquor store around 10 p.m. near Vermont and B streets shortly after he'd gone inside to buy ice cream for his daughter.

As the father and daughter walked home, the suspect asked Cunningham to hold back his dogs as he passed.

Cunningham was walking a 1-year-old German shepherd and a smaller dog of unknown breed, police said. Both dogs were off-leash but were not behaving aggressively, investigators said.

Upset that the German shepherd sniffed his leg, the assailant exchanged words with Cunningham, then shot him with a handgun, according to police.

The daughter ran inside the liquor store for help. Cunningham died at Eden Medical Center in Castro Valley.

The killer ran south on Vermont toward Hill Avenue, police said. Witnesses described him as black and in his early 20s, with a slight build. He was wearing a dark brown or black hooded sweatshirt, possibly with an orange design on the front and with a white logo on the hood. He was also wearing baggy blue jeans.

Police asked that anyone with information call Inspector Rob Lampkin or Inspector Fraser Ritchie at (510) 293-7034, or police dispatch at (510) 293-7000.

Not covering for the coward that shot the man, but I do hate when people let their dogs step to me or my kids. This happened to me once and I damn stomped the dude out. But his dog was acting aggressive and the owner was saying the dog didnt bite.

But yea that is some coward shit. Plus that kid will be scarred for life. I hope the catch dude and give him a little brutality before he makes it to the station.

Baggy pants and a hooded sweatshirt...what a surprise! Until the dog actually attacked you then maybe you could shoot the dog, not the owner. And people blame cops for profiling...lol. That guy fits the discription of 1/4 of the people in Hayward

The bay has been fucked up for a while. Many cities which used to be very nice have now gotten much worse. I think a lot of the problem comes from the fact that people can easily get away with a lot of shit. How do you id this guy and how do you find him...it hella difficult. The more criminals know this the more shit gets worse. That is why I am a firm believer that good citizens should be able to protect themselves but these stupid fucking hippie ass Californian's are scared of good citizens carrying a gun. But none of the laws apply to criminals because THEY DONT FOLLOW LAWS!! [BS flag]

I think you should read my post closely before you mention stomping me or my kids out. dude was not being a responsible owner. if your dog is scaring a kid or pedestrian you reel him in. you don't say oh he don't bite. all I was saying is I have been angered by a similar situation. I am hoping I am reading too far into your statement. because it sounds like you trying to clown. and please never do so by using my kids as a point.

na i have american bulldog i i have lots of kids that come up to to her to fast an start moving around her an she gets scarred an has never try to bit anyone but i had animal control out my house more than once b/c a parent got scarred of my dog for things there kids did.if you show a dog no fear at all the will back down

ok well, not to water down the original post. But as I said, this persons dog was being aggressive I nor my son wanted any parts of the dog. But instead of reeling him in, he chose to let the dog advance and tell us he dont bite. So my reply was "he got teeth right muthafukkah?". Now if this was you and you did the same thing and you really think you are right then you deserve to have your ass kicked and your dog taken away. If a person wants no part of your dog and we are on a public sidewalk, do something about your dog. I am not saying the person nor you deserve to be shot. But with that attitude you have about it if I am understanding you correctly. Will most definitely get your ass whooped by myself. Now back to the original topic. Have a great day [Big Grin]
