Another Bart incident. looks like Bart isnt at fault this time. guy was drunk and wanted to fight everyone

I see a drunk asshole getting what he asked for. And I think I saw (or heard) some happy BART customers giving applause where it was due. I think I also saw that guy put his hand into the window when the cop was putting a control hold on, and I think I also saw the guy not listening to the cops instructions to "get on the ground".

Geeze, that cop was an asshole. He should have just ignored the guy and let him be on his way, freedom of speech and all... [Roll Eyes]

+1000 Drunk ass got what he deserved, there was women & children on that train and he is acting crazy, you get handled. BTW if you watch the video again the suspects throws a punch at the glass. And if you have been diagnost with bi polor or scitzo dont be getting drunk in public, not a good combo.

if the guy was out of control on that train why are you handleing the guy all by yourself? maybe they (bart police) are tring to make the situation seem more extreme then it really is (out of control combative drunk [Roll Eyes] not saying its not possible but.... since when does the a cop subdue an out of control person by throwing them at a wall, why not take him straight to the floor. to me it looks like the cop was attempting to ruff the guy up.

Well consider that dude paid. The broke window all but insured that. Right or wrong he is paid as in the a legal sense that is excessive force. Now in a street/holding court in the street sense. He got what he deserved. Cop will lose his job, guy will get paid. Sucks but it is life these days on BART. Why work to get rich when you can ride BART and get paid by actin a ass.

No doubt, he will get paid. I do agree that he probably should have taken him to the ground. definitely not the same as getting shot in the back.

Hindsight is always 20/20 and there is always something that could have been done different or maybe even better.

The man and his family will get some type of settlement only because it is cheaper for BART and the taxpaying citizens to settle out of court than litigate in a courtroom.

You must didnt watch the same vid I watched lol. The officer did put some "umph" on the relocatin to the wall. The dude was not struggling or fighting and appeared to be subdued for the most part IMO. But like I said, I have no sympathy for the offender and feel sorry for the cop. But even I could get a cool settlement for him with that video.

yeah, I don't think the cop will lose his job over this but because of the other recent incident involving bart police this officer will be disciplined in someway.

about that guy breaking the glass on his own, i don't know but it would take some good force to break thick glass like that and raising your arm isn't going to do it unless you were forced into it. remember he didn't punch that glass he only raised his arm to it and that isn't enough to break it unless you got momentum (shoved)

You can see the suspect clearly dragging his feet and resisting the officer's escort and then continue to resist all the way to the ground.

You can see how agitated and unstable the man is on the train and the confrontation that is just starting to occur with another BART rider... The officer has to go in there and take control.

What do you want the officer to do?

Officer: "Sir, Sir come step off the train and tell me what is going on" (because I have no command presence and I am afraid of what people might think tomorrow.)

Suspect: "Fuck you, I am king of this...blah blah"
(Giving the suspect time to take a fighting stance and making a bad situation worse. It would have been all bad if it would have gone hands on in that small train car with a crowd of people)

Like I said, hind sight it 20/20, but that is not how reasonable force works in our country... The officer used necessary and reasonable force at that moment to overcome the resistance of again a clearly agitated and unstable man.

I want to know why that was glass and not plexiglas or some other material... That is really what makes this whole incident look bad.

Sometimes you have to check someone against a wall to get their attention and overcome their resistance and again that would not be "excessive"!

If he took him straight to the ground in the train or right outside of the train, he would have had to deal with the people on the train possibly interfering or antagonizing the suspect making him more resistive... well when i wrote take him to the ground of course I meant off the train first, common thats given remove the guy from the situation away from the train first.

I agree that the person was not responding to the officers commands, if the officer took him straight to the floor and he did hit his head I really don't think there would be that big of a media mess from it. taking him to the ground and he gets injured from it you can argue that situation alot better then him getting injured from a shove to a wall/glass window. its always hindsight of what should of been done but that shit don't look good, period and a picture is worth a thousand words. he won't be fired and I don't think he should be for this but there will be backlash from the public if nothing comes of this. too many incidents in such a short time from the same group (bart police)

My point is IMO, the slam against the window was excessive. And it will not take much to prove that it takes a good amount of force to break a window that thick, thus a guilty would not be hard to get on a excessive force charge. Which will lead to mental anguish charges, which will lead to civil rights charges, which lead..... you see where this is going? Whether he deserved it or not, who knows. But judging from the video, getting a jury of his peers to say guilty doesnt seem very hard. Especially coming off the last BART issue. They will probably bend over and just take it.

Lol! I was just watching channel 2 news. They said this guy was arrested earlier in the day for & I quote "kicking a 84 year old man in the pants while riding the bus in Daly City". What a skitzo. People like that can snap at a moments notice. That officer was doing is job. Was he a little ruff, maybe. Oh well, that guy could have brought harm to somebody worse than that. Split second decisions are ruff.

Dude! That is exactly what didn't happen on that video Ive heard people yelling on BART all the time and no one gets arrested he was obvious causing a bigger problem then just yelling if someone complained and they went through the trouble of holding up the train to get him out. I'm not a huge fan of law enforcement BUT some are cool and this guy was just doing his job

Has anybody heard the audio portion or just seen the video with no sound? The people on the train were completly backing the officer saying that he was doing his job and that guy was out of control, even offering the officer assistance while blood was spraying from his head. That doesn't happen when people think the cop is using excesive force.

Drunk got what was coming to him. Several 911 calls were saying the guy was threatening people on the train challenging them to fight.
The officer got a concussion, so he got more hurt than the drunk.

Bro I understand your argument about free speech, but somethings are not protected under free speech ie: threats, like this guy was making. You can actually get in trouble if you tell someone you want to kill them or stab them etc. If your screaming " I love obama eat cock you publicans" then yes a cop should not face plant you into a window or the ground. But the moment you start to threaten other people you should be dealt with accordingly. Again threats are not protected under free speech.

Anyone who thinks that the cop was out of line in that video is a real piece of work! Piece of something else is probably more like it.

You get out of line and threaten people, you stand to get restrained. Sometimes when people are restrained, they get hurt. It's part of what you sign up for when you choose to get out of line in a public place and be an idiot.

I don't see that cop intentionally putting his head through the window. That was incidental.

Terrible that our officers get so much scrutiny for simply doing their jobs, and a tough job at that!

Not taking homies side, but there will be a lawsuit and he more than likely will get a settlement. It takes some force to shatter those windows and it wont be hard to get some cash out of BART on this one. Deserved it? I think so. Excessive? Yes. Paid in a lawsuit? Definitely.

They received 12 911 call asking for help. you get that many calls the police are not going ask questions. , that officer was responding to those calls and did a great job. if there was safety glass installed nobody would even be talking about it. The officer sustained more injury than the suspect. I hope he is doing well. If that was my grandmother or kids on that train, I would have stepped up put him to the ground until the cops came. Bottom line is: free speech doesn't protect threatening others.

Also you shouldn't be given the option to move by your own free will if you threaten others. What if the cop says "please step out sir" and the guy starts running or the guy knows he is now caught and wants to swing at at least one person or the cop. When someone is proving to be a threat then they are dealt with properly.

The way you are making it out is as if the guy was just riding bart and was pulled off for no reason. That is not the case. This guy was threaten others. The big problem is the THREATS. I bet if he wasn't threatening anyone and was just drinking a beer on bart, the cop would have said, put the beer down step out side, put your arms behind your back etc.

Also we as citizens give cops the authority to make decisions on the fly. We cannot always have a judge present to tell a cop what to do. A cop only has a second or two to make a decision on how to deal with a situation. The job is stressful and they see a lot of crime which can make you see things totally differently than an average person. The cop doesn't know if the guy has a knife or gun etc

Rant ON: this is why cops hate tinted windows because they can't see what they are approaching. I hate the fact that it's illegal for me to have tinted windows but at the same time respect where they are coming from too...Rant OFF

Exiting the train doesn't mean your not going to jail for threatening the lives of others. I don't know why you don't understand that. The guy resisted arrest after getting off the train that's why the cop got more physical, he already sealed his fate, he wasn't going home after getting off the train. You don't get out of going to jail when you stop doing something that is illegal.

The officer used that force which is necessary to overcome the resistance of the offender to effect a lawful arrest. I don't see why the police should be defensive about anything here. Unless you've wrestled with anyone trying to fight you in the line of duty, you will never know. Your ignorance is apalling, but somewhat typical of a common shitbird.

The freedom of speech is not absolute; there are restrictions. You cannot yell "fire" in a crowded theater, nor can you make threats likely to provoke a public disturbance (415 PC).

Gotta love how people throw out that "to protect and serve" idea when there are allegations of brutality. In the opinion of many, the officer was protecting and serving the passengers. The first and foremost responsibility of an officer is to enforce the law and vigorously prosecute those responsible for crime.

I don't understand what the hatred or negativity towards the cops are fr5.0. In fact, each time I've been pulled over for a broken windshield, tail light out, etc etc, the cop has told me to just fix it and wanted to make sure I knew about it. Come to think of it, all of my experiences with cops so far were the result of me doing something wrong or illegal, and they were all polite to me. Maybe you should join copwatch so you can hang out with the rest of the cop haters.

Thank god there's only one person (so far) who feels like Fr5.0 and the majority will rule, just like in court which you love so much. Bless that officer for doing a good job and getting rid of that piece of trash so we can go on with our lives. If any more Fr5.0's come along and try to stop them from this the cops won't do anything for us at all. It will be a free for all for the criminals to go and do whatever they want because the cops will be to scared they'll lose there jobs. You know looking at the video again it looks like he was going to put him against the wall to cuff him rather then put him on the dirty ass ground but when it broke and he continued to resist he had to put him on the ground and lock his wrist... Never punched him kicked him or any of that good stuff, I mean flashing his dick? Let him flash his dick at your mother and/or sister then we'll see how you feel about this video

I love the tazer the old lady video...She was warned so many times he should have tazed her sooner. Its so funny how many people scream police brutality. The truth of the matter is yes, its probably out there. But these are terrible examples of it. An officers job is extremely difficult and people get way to charged up to support a criminal.

Either way she was in the wrong. You NEED to listen to a cop when they tell you to do something simple as that. All of that could have been avoided if she just did what he said. Instead she wanted to act a fool. The final decision was hers and she made it, so the cop acted accordingly. Wrestling with her and tasing her are both non-lethal forms of subduing her.

That's why America is so great. You can believe what you like too and I can too. I think that lady deserved what she got. Everything could have been avoided. If people just listened to cops and stfu, things wouldn't have to escalate.

Apparently there is not win win situation with you. Why do you want cops to put pillows on the ground before they subdue someone.

cops get paid to get phisical, and are trained to know how phisical to get!!!
if an untrained person can tell that a trained cop is is over the top there is a problem!
trained means that they should be able to do there job without using unnessicary force!!!!

I would like you to prove to me how you can tell from the bart video that the guy was compliant with what the officer wanted?

Even though shes 73 years old some force would have been used to constrain her, and this force probably would have been to much force for you to accept as needed.

I just finished watching cops <--- [Razz] and this one bitch was hella feisty and wouldn't listen to the cops, they slammed her fat ass to the ground and hog tied the bitch! "Good" I say. Then another person they pulled over was trying to eat his stash but he got out was calm did what they said and they just cuffed him....what does that tell you? [Confused] Force will be met with force.

watch the bart vid again, the fat man tells him to get off then the cop musta said something also, but as he starts to get off the cop reacts as if the man was running the other direction this is what is called "over reacting"!
there was a piller two feet from him on the right, what was the reason for the full speed towards the wall? the glass may have been a coincidence but then to try to lay some one in broken glass for something the cop did, not cool and not professional! you wouldnt have lay down in broken glass either, i guarantee it!!!!

tell me again why were arguing.........because it didnt happen to you?????
