I GOT A TICKET FOR EXHIBITION OF SPEED 100+ ON 101, IN THE SAN JOSE AREA BY A SANTA CLARA SHERRIFF NOT CHP. HE FALLOWED ME FOR SOME MILES UNTIL I EXITED THE FREEWAY AND THEN PULLED ME OVER. I AM LICENSED WITH FULL COVERAGE INSURANCE, AND HAVE MINOR TRAFFIC VIOLATIONS ON MY RECORD A 1YR OLD. HE IMPOUNDED MY CAR FOR ONE MONTH AND WROTE ME UP FOR WRECKLESS DRIVING. I HAVE COURT IN A COUPLE OF MONTHS AND I WAS WONDERING IF I SHOULD FIGHT IT OR TAKE A LOSS? I ONLY FEAR HAVING MY LICENSE TAKEN FROM ME.

115+ in Marin and that's the one I lost. LOL....Dude, from experience. On this ticket get a lawyer to fight it. I got 30 day suspension and $475 fine. My insurance was/still is affected (3 years on record for insurance rates). Factor in all the money that you will spend on the extra insurance. That's why I say get a lawyer. It will cost up front, but could potentionally save you money/points on your record.

That violation is a automatic two point violation. Your insurance takes away your good driving discount and considers you a risk.

Fortunately the Sherriff patrol did not ticket me for wreckless driving. Excess of over 100+. My car did not get impounded (thank god). GET A LAWYER.

Put it like this, I sold my 2003 Cobra because of this ticket. My insurance was going to be $400-500 a month. This was my only ticket too(on record, I had no points before this). But it was a serious one!

Sound's like a 2 point major violation which the insurance consider's the same as a DUI. Back in the 90's I had a DUI & a couple year's later I got a open container ticket, when the DUI dropped off I went in to get My insurance switched back to full coverage and they told Me it was going to be over $5000 a year [Eek!] because the open container was considered the same as a DUI "2 point major violation" to the insurance but would drop off My record in 3 year's. No more drinking and driving or drinking while driving for Me!

I got Busted in San Jose for the same thing 23109 exhibition of speed about 2 years ago. They also took my car but I got a lawyer $5,000 later and the chrages were dropped. I still got the lawyers number if you want it. I would highly recommend getting a lawyer espically if you want to keep your L's. PM if you want the number he is in San Jose and Hes VERY Good!!! i would highly recommend not speeding anymore. if your doin something stupid like exhibition of speed or driving over 100 mph your pretty much done. you can spend the thousands of dollars for a lawyer and still then theres JUST a chance your gonna get off. trust me, ive been in traffic court more times than some cops have. the judge knows me by face! had license suspended 4 times, COUNTLESS tickets, and moving violations. impounded car twice ($1500 each time to get it out). thousands of dollars in fines. after so many you just cant afford them any more and you eventually learn to keep it cool. when you have to pay for all this shit yourself and mommy and daddy arent there to help you out, its not that fun. ive had my lisence since i was 18 and had a record along with an ongoing fine collection account ever since. im 25 now, and you dont want to spend the money that i have on stupid ass fines, tickets, tows, impounds, and lisence re-instatement fees that i have. not to mention the time taken off of work to deal with all this shit. i could have owend a house by now. TRUST ME! slow down. take the ticket do the traffic school if eligable (now 2x in 18 months) and be done with it. oh yea, dont forget to save up for that fine. you can set up a payment plan with the court if your broke like me.

sorry, got off track with the rant, i have gotten outta my fair share of tickets. hope the cop doesnt show (which i understand that it is almost all cities policy for issuing officer to show even on their day off=double time pay) you can keep asking for an extension, hopefully the cop that issued the ticket wont show due to the fact that they can only take a certain amount of days of a week to be in court or the court date is set for a day that they work. or you can hope that they didnt file a report (happened 2x to me and got of. yeeee!) or you can hope that the ticket is for some dumbass reason and you can find some loophole out of it and rep yourself.

You're not going to have an option for traffic school for a two point violation. Even if your eligible, two point violations eliminate that option.


Listen, this is what you gonna have to do. I went through this exactly two years ago (without the wreckless driving).

Sign up for ticketassassin.com first for the latest letter templates. In the meantime when you recieve your notice from court. Delay the court date as many times as possible. Most courts nowadays allow only one extension. Extend it to the farthest date possible. If your not allowed a extension. Request for trial by written declaration, keep in mind this needs to be done a week or sometimes more before the due date. In my situation I wasnt allowed a trial by written by declaration intially by the court clerk and was told it was mandatory to show up in court to plead not guilty or guilty. So I did that and showed up in court. The judge asked if I wanted to plead guilty, no contest, not guilty. I asked the judge if I can do trial by mail. She said no, especially because of the violation. At that time not knowing the truth, I still plead not guilty. She didn't want to show the people in the court that was an option. So she flatly denied me. I went home and explained what happened to me in court to ticketassassin and he told me that the judge was incorrect and should have allowed a trial by mail. So he typed some letter up and told me to submit it to the supervisor of the court and letting that person know that the judge was wrong for denying my request under so vehicle code. A couple of weeks later I received an apology from the supervisor by letter, along with them granting me a trial by mail.

Long story short:

Sign up for TICKETASSASSIN.com
Wait for notice of court date
When you receive it, call into extend court date

Hope that the letter wins it, or the cop doesn't respond by mail.

are you sure? its been a while, but the many times i have been to traffice school were for 2 point moving violations.

My ticket charge was in DEC of 2005. I was not able to go to traffic school for CVC 22348. Either way, if that option is available to him. It will be noted in the letter that he sends. If the court allows it, they will offer it to him.

I'M A SAFE, SLOW DRIVER. I SWEAR! LOL. IT WAS AFTER HOURS, TRAFFIC WAS LIGHT TO EMPTY AND I DIDNT DO NONE OF THAT SWITCH LANES FOR NO REASON BULLSHIT AND WHEN I DID, I SIGNALED! YOU CAN SAY IT WAS A ONE TIME THING AND IT ENDED UP BITING HARD IN THE ASS!

I got an exibition of speed years ago and my insurance killed me. Fight it. Try to get it reduced to an infraction. Your current violation is a misdemeanor and you can get a jury trial by pleading not-guilty.

The whole goal is to get it reduced by stalling it out. Although the DMV counted it as 2 points your insurance provider can count it as 10!!!!!!

Also, your ticket wont be reported to the DMV until a conviction is rendered. That means your insurance won't find out about until months later because they pull DMV reports every quarter. But if you don't get it reduced and the misdemeanor sticks then you have to wait longer to have it fall off your record. Took me 7 years for mine to fall off. PM me if you have any more questions.

You can fight it that way. However, you will be admitting that you did spin your tires which is the violation you were cited for. You will have to convince the court that it was not driver error and in face you were well within your paremeters. Since you will say not guilty you can call for the evidence from the police officer. This should include all personal notes that the police officer made. These notes are very important because it gives you an idea on what the police officer saw and you can use this refute his argument. You have to convice the judge or jury that the police officer could have been mistaken. Line of sight, traffic, time of day even how noisy it was during the alleged violation could help you.
I believe you can even get a copy of the transcript from dispatch to see how busy it was during that time of the violation. If you can prove that the officers attention was not 100% you can get off.
However, police officers go thru intense training and are very hard to prove wrong because of this.

Todays police officers are very good at what they do.
