Technically you CAN still get a DUI for sleeping in the driver's seat of a car while you're drunk since you are in control of the vehicle. The vast majority of officers would just ask you to slide over to the passenger seat but, of course, there is that small percent that are badge heavy and will go letter-of-the-law on your ass...

Only if you have the keys in the ignition can you get a DUI when your in the driver seat, also if your in the passenger seat and the car is running you can get a DUI.

not true... *true story* my friend who is a Sheriffs daughter was given a DUI charge for unlocking her car and proceeding to climb into the drivers seat even though she was only hoping in to grab a jacket across the seat.... No BS... "intent" of a Dui
