i got my last ticket for speeding 45 in a 25 in alameda on my way to my last finally may 2005,
the cop said i can talk traffic school online, is that true? and will this be a point?

He might not have known that you had another ticket recently. Call the DMV or a traffic school or something like that to find out for sure.

There is still hope, both my housemate and I have gotten tickets with those 18 months and were given the option to go to traffic school. Don't know if they aren't strict in enforcing that rule or if it the county, but we were pretty happy about it.

The officer has no way of knowing when the last time you went to traffic school was. He was probably just letting you know that the violation could be erased with traffic school.
But here is a little bit of hope (copied from an online traffic school site):
The California Vehicle Code (CVC) provides that if you have attended an 8 hour class in the past 12 months (from your violation date), you CAN go back to traffic school for 12 HOURS, at the discretion of a judge (not to be confused with the automatic 18 months non eligibility the court of your last traffic school says it allows...forget that! You can ask anyway.). You must make an appearance in court and NICELY, and POLITELY ask the judge if he/she would consider allowing the following since the CVC gives them discretion to permit you to go. REMEMBER...you get more with HONEY than with VINEGAR (as my mother used to say):
41501. The court may order a continuance of a proceeding against a person, who receives a notice to appear in court for a violation of any statute relating to the safe operation of a vehicle, in consideration for attendance at a licensed school for traffic violators, a licensed driving school, or any other court-approved program of driving instruction, and, after that attendance, the court may dismiss the complaint under the following conditions:
(a) If the offense is alleged to have been committed within 12 months of another offense which was dismissed under this section, the court may order the continuance and, after the attendance, dismiss the complaint. The court may order attendance at a licensed school for traffic violators which offers a program of at least 12 hours of instruction.
(b) If the offense is not alleged to have occurred within 12 months of another offense which was dismissed under this section, the court may order the continuance and, after the attendance, dismiss the complaint if the attendance is at any of the types of schools or programs that the court directed pursuant to Section 42005 at the time of ordering the continuance.
This course will cost more money than the 8 hour class (usually $10 more), and will NOT be MASKED from the insurance company that you attended. What will appear on your DMV record is:
T/S violation Date
which means your case was dismissed by traffic school. Can an insurance company raise you because they know you went to traffic school? NOPE. Can a FUTURE insurance company penalize you for knowing this? YEP. But it's still a good idea to go and keep the points off your record towards losing your license.

the cop asked my if i have gotten a ticket before and if i took traffic school, i told him may last year i got a ticket and took traffic school, and he said i could take traffic school for this ticket.

Well, either way you will receive a letter in the mail laying down your options. If traffic school is one of them, it will be on that letter. Not much you can do until you get that letter. But if it was may '04, I don't think you will be eligible. Better off fighting the ticket and hoping the cop doesn't show up, or by pleading guilty and hoping the judge allows what I posted above.

Hmm, perhaps your city/county does things different. Every county, city, and CHP encounter I had always began with a letter in the mail stating my options and fees (it tells you what to do if you want plead not guilty and fight it, or if you want to accept guilt and do traffic school if eligible, or if you want to do a trial by written declaration).
But you have a lot of time so I'd just wait a while and watch your mail. Or if you just want to get it over with, just stop by the clerk and they will be able to tell you what you can do.

with my first ticket i didnt get teh letter till 3 months after i got the ticket. then another 3 months to do traffic school.
but my main ques is will i be able to take traffic school as a option, becuase i knew about that 12 month rule with traffic school, and i told the officer that it has been 10 months since my last ticket and i took traffic school for it, and he said i should be able to take traffic school for this ticket also.

if u took traffic school in the last 18 months then no u cant,but if they offer it take it.
this happened to me i got a speeding ticket,took traffic school.
then 7 months later i got another ticket and they offered traffic school and i also took it,neither ticket appeared on my record.
so if they offer it take it,it cant hurt

No one here will be able to tell you if you can take traffic school. It's going to be up to the judge. If you have taken traffic school within the last 18 months, well California law states that you are not eligible and will have to wait until after the 18 months.
I received a ticket in Sacramento one time and tried to get traffic school, but they said it had been 17 months and not 18. So instead of pleading guilty I fought it and thankfully I ended up winning lol.
Just go to the clerk and ask if you are eligible. Or give them a call. If you aren't, they will tell you what you have to do to proceed (or to make an appearance with the judge to beg for TS).

There is such thing as LEVEL 2 Traffic School. And yes, if you ask the judge for it, they will usually will give it to you. I know about 5 people that have taken it, and it is for people that have already used their traffic school 1 within 18 months. It is like $35 more dollars than level 1 and it consists of 2 days instead of just one day.
There is even a LEVEL 3, but I believe that is just for DUI people.
